The social injustice caused by this practice was the primary motive for our country to enact the Federal Bankruptcy act in 1898. The Congress has enacted major amendments to the Bankruptcy act which became effective Oct. 1, 1979. According to the Illinois State Bar association, the « purpose for the original act was to provide relief from debt by permitting the Federal court to dismiss the debt. Thaamendments to the act were passed primarily to modify the act and enable the bankruptcy court system to deal realistically and effectively with the rising numbers of consumer bankruptcies experienced since World War II. The right to petition for release from debts through bankruptcy is accompanied by certain requirements and obligations. The Illinois State Bar association says a person filing for bankruptcy must comply with the following requirements: Eligibility: Any person who cannot meet financial obligations as they become due may be eligible to file for bankruptcy. Ftling: The proceeding is commenced by filing a petition in federal court and must be accompanied by a prescribed filing fee. Obligationa: The final result of a successful petition for bankruptcy is called a "discharge" and has the effect of releasing the debtor from past indebtedness. A person requesting such discharge must: 1) file a "schedule" or list of all assets, liabilities, and a statement of their financial affairs. Failure to list all creditors or assets could prevent a discharge of debts not listed on the schedule. Failure to comply honestly with the Bankruptcy Act could also lead to criminal penalties. 2) cooperate with a court appointed trustee who will represent creditors and determine the proper distribution of assets in order to satisfy the debts. As soon as possible after a bankruptcy petition has been filed creditors are notified and a debtor is temporarily relieved of paying the debts and cannot legally be harrassed. 3) attend all meetings required. An additional requirement which calls for all assets to be turned over to the court can be adjusted through a set of exemptions provided under Illinois law or a set of Federal exemptions. A debtor has the choice of claiming either set of exemptions. . Any person whose financial problems are reasonably complex should seek the advice and assistance of an attorney. A lawyer can fully explain bankruptcy procedures and can also advise the debtor as to possible alternatives. TWICE TOLD TALES FIFTY YEARS AGO (Taken from the files of August 28, 1930) Lowell Nye, Harold Vycital and Orval Granger returned home from a truck trip through Illinois and Missouri witlu^the Boy Scouts. The trip&arted from Camp Rotary ami was an interesting and instructive one. M. L. Schoenholtz, teacher of the fifth grade in the local school, was one of the executives to accompany the hoys on the trip. About 30 scouts made the trip in a truck, sleeping along the way in pup tents. Meals were eaten at restaurants. The fifth annual homecoming was held by the Ringwood Homecoming association at the Modern Woodman hall in Ringwood. Invitations to attend this meeting has been extended far and wide and almost 150 people gathered to enjoy the day together. Familiar faces were seen at the homecoming from all parts of the country and various states of the union and these former residents of Ringwood and vicinity were greeted heartily and gladly welcomed by the local people. FORTY YEARS AGO (Taken from the files of August 29, 1940) Clarence Smith of John- sburg submitted to an operation on his eye at Michael Reese hospital, Chicago. After losing the sight of one eye in an ac­ cident six years ago, he later lost the sight of the other eye. Now, however, by transplanting a cornea into one eye they are attempting to restore partial vision. Miss Eleanor Althoff, a student nurse at St. Therese ' s hospi ta l , Waukegan, was allowed to witness the operation. After three months of vacation, the students of the McHenry Community high school were glad to return to their alma mater to register and meet many of their classmates whom they had not seen since the close of school and to prepare for the opening of school Sept. 3. Rev. A.W. Blood, pastor of the McHenry Community Methodist church, will preach his farewell sermon and he and his family will leave for Missouri, where they expect to make their home. TWENTY-FIVE YEARSAGO (Taken from the files of August 25, 1966) Parishioners of St. Patrick's Catholic church and the many friends of Rev. Fr. John F. McGowan learned with regret recently that he had enlisted as chaplain in the Air corps and would be leaving McHenry soon after Labor day. He has been assistant pastor at St. Patrick's since April of 1952. Father McGowan, who will hold the rank of first lieutenant, will take eight weeks of training at a chaplain's school at Lackland Air base, San Antonio, Tex. After that his place of duty is uncertain. The City Council has received many complaints during the summer season regarding offensive odors caused by persons burning garbage and rubbish. Several appeals have been made in the hopes that the practice would be, stopped without causing un- pleasantries through or­ dinance enforcement which might result in court action and the possibility of a fine being imposed. Warren Jones, McHenry tenor, placed second in the preliminary contest to select those who would appear at Soldier field in the Chicagoland Music festival. He appeared in competition with a number of lyric tenors. TEN YEARS AGO (Taken1 from the files of August 21, 1970) The City Council approved the annual tax levy of $250,000. Last year's total levy amounted to $270,599.07. McHenry is listed to receive $2,331.83 as its share of the distribution of $4,306,416.63 to mun­ icipalities and counties in state income tax collec­ tions for July. Topping the county were Crystal Lake and Woodstock. From his native city of Detmold, Germany, Armin Schwolgin has come to McHenry to spend a year under the American Field Service program. Joining Woody and his family, wife, Pam and son, Zachary, for a day of colorful French fur trapper-era activiities will be John and Lloyd Liedtke of Whitewater, Wis., hand- craf te rs of l ea ther and pewter wares, and Steve Hakes of Rockford. Hakes will be dressed in moun- tainman or buckskinner costume and demonstrate tomahawk throwing and flintlock rifle shooting. ^ The Woodruffs, Liedtkes and Hakes are part of a small but growing group of individuals dedicated to preserving and reliving the life of Fren6h fur trappers and mountainmen in the years prior to the 1830's. The Woodruff family, well known in McHenry county, haye been actively involved with the National Muzzle Loading Rifle association and the National Association of Primitive Riflemen. They, along with other such en­ thusiasts, rendezvous or meet at the sites of the first trapper gatherings to trade original and authentically reproduced Indian items and participate in pioneering activities. The Sunday "Buck­ skinner" program will commence on museum grounds with displays of early fur trade era items, authentic trapper and Indian costumes, teepees and demonstrations.
