Public knowledge and understanding of our judicial process is often derived from t e l e v i s i o n c o u r t r o o m dramas and police shows. According to the Illinois State Bar Association these dramatizations can be m i s i n t e r p r e t e d a n d sometimes lead to misconceptions about the criminal justice system. They can also leave un­ certainties about the role of lawyers who represent defendants in criminal cases. As advocates for defen­ dants who are accused of breaking society's laws, defense lawyers are sometimes misunderstood because many aspects of c r i m i n a l l a w i t s e l f a r e m i s u n d e r s t o o d . F o r example: If a defendant confides to his lawyer that he did indeed commit the crime, the lawyer does not have to disclose the client's ad­ mission of guilt to the court or to anyone else. The lawyer may urge the client to change his plea to guilty but the accused has im­ munity from self- incrimination under the 5th Amendment to the U.S. Constitution. The lawyer is b o u n d b y e t h i c a l a n d professional obligations not to reveal statements made by the accused in con­ fidence. It is up to the lawyer in private practice to decide whether to accept a par­ ticular case and a lawyer may refuse to defend a person who is accused of a crime. However, the Con­ stitution also says the ac­ cused has a right to legal counsel and defendants who are unable to pay for legal representation may be defended by a court ap­ pointed lawyer. The defense lawyer's responsibility is be be an advocate for the accused, doing everything within the law to clear the defendant of the charges, but it is not the lawyer's responsibility to determine his client's guilt or innocence. It is the responsibility of the prosecution to prove the defendant's guilt beyond a reasonable doubt and it is up to the court-the judge or the jury-to decide guilt after hearing evidence from both the prosecution and the defense. The attorney's job is to advise the client about the various decisions to be made and how the defense will be handled. The lawyer should make sure his client fully understands the con­ sequences of such decisions, but it is the client who must decide and bear the con­ sequences. The goal of insuring justice in our society demands that defendants be represented by competent legal counsel who vigorously fulfill their duties to their clients. The Illinois State Bar Associaiton says every lawyer is sworn to uphold a code of professional r e s p o n s i b i l i t y w h i c h requires the lawyer to "represent a client zealously within the bounds of the law." Failure by a lawyer to represent a client's interest to the fullest extent possible c o u l d b e g r o u n d s f o r disciplinary action or for a lawsuit against the lawyer for malpractice. MCC Plans Handicap Awareness Activity Area residents are invited to attend a special Handicap Awareness activity at McHenry County College on Thursday, Oct. 16, at 1 p.m. In observance of the sixth annual Handicap Awareness week, the activity, co- sponsored by the MCC Student Life committee and the Easter Seal Society of McHenry county, will be held in the college lounge. Activities planned during the day will include "Han­ dicap Trails" designed to increase the awareness MCC students and staff and area residents have about the problems of the han­ dicapped. "Participants will use wheelchairs, crutches, blind­ folds, and walkers in dif­ ferent areas of the buildings to determine how barrier- free the college campus is to the handicapped student or r, expl Welch, MCC students ac­ tivities director.
