Msrty Gooddsrd, executive director of Citisens for Victim Assistance, a Chicago based rape crisis group, says crimes reported are probably less than a quarter of the rapes perpetrsted in the state The FBI estimates that only one in ten rapes is reported. M a n y o r g a n i z a t i o n s s u c h a s t h e Citizens for Victim Assistance are working diligently to east the suf­ fering of rape victims and their families Legislation already passed here provides state funding for rape v i c t i m s a n d s u p p l i e s a u n i f o r m method of collection of evidence in a rape case Police and medical per­ sonnel now have special training to h e l p t h e m d e a l e f f e c t i v e l y s n d compassionately with rape victims. These steps are needed But, they are not enough. Significant efforts must be made to keep rape from happening in the first place. Another way to stop s rapist is to prosecute him At the present time, there are two bills which would make it less traumatic for a victim to prosecute s rape under considerstion in the legislature. HB 2185 -• Allows a victim of sn alleged rspe or sexual assault to have a relative or friend present during queetioning by s law enfocement officer At the crucial time for Questioning, immediately after the crime, a support person can be a great help to the victim snd therefore to the investigstion process. HB 0483 - Allows for the presence of s support person during snother key time in the prosecution process. The bill sllows a friend or relative to be with a prosecuting witness during s preliminary heering and trial. Both these massures can help ease unnecessary traums for rape victims snd should encoursgs prosectuion of the crime. HB 1748 - Also encourages prosecution for rspe. The bill makes a distinction between repe or sexual asssult and aggravated rape or sexual assault. The division makes non- aggrsvated sex offenses a Class 2 rather than a Class X felony. The class change means s lower man­ datory sentence is required. This msy sound like a stop back­ ward, it isn't. At the present time, most simple sex offenses are plea bargained to battery or general asssult chsrges. Consequently, s rspist leaves the court and penal system with no record of a sex of­ fense. With this change, a rapist will be convicted of the crime he commits, rspe. Rape is not the same thing as bsttery and it should not be treated as such in our courts It is important to recall that the claasificstion has not been changed for aggravated rape or sexual assault An aggravated crime occurs if the offender is armed with a dangerous weapon, inflicts bodily harm, com­ mits snother felony upon the victim, wears a hood, robe, mask or con coals his identity, enters a dwelling or lodging by force or commits the set upon s person under the age of 14. The bill makes a successful rspe p r o s e c u t i o n m o r e l i k e l y w h i l e providing appropristelv severe penalties for aggravated rspe. HB 1708 - Also makes changes in the way rapists are tried. The bill requires that persons sged 15 -16 to be tried in criminal court, not Juvenile court, for the crime of rape. HB 1229 -- Makes sn extended sentence possible in s case of multiple or gsng rspe. An extended sentence mesns thst s term of up to twice the stsndsrd sentence is allowed. HB 1129 -- Also sllows stiffer sen­ tences for rape cases. The bill would allow a term of natural lifs in cases of exceptionally heinous crime or in the esse of a previous offender. A person convicted of rape within 10 years of s second conviction (excluding time served in prison) may receive a life sentence for the second conviction. HB 2120 - Requires thst criminal serve more of their prescribed terms in prison. The bill changes the rate by w h i c h g o o d c o n d u c t c r e d i t s a r e earned in the case of rape. Ins teed of one day of good behaviour earning a day's reduction in sentence, one day win eern only a half day's reduction. These measures combine to make the crime of rspe eesier on rspe victims snd toughsr on rspists themselves. It is a combination which will help eradicste the terrible effects of rspe in Illinois.
