By Angela Burden and Ken Wysocky Shaw Free Press News Media Charges of child cruelty and reckless conduct against Earl and Ann Adams Ketchum, stemming from the death of 5- month-old Earl Ketchum Jr. in 1982, have been dropped. But charges of involuntary manslaughter and reckless aftiduct and cruelty to a child are still pending against Rethel Devine, the infant's grand­ mother, according to McHenry County State's Attorney Ted Floro. A hearing on those charges will be held Dec. 28, and it is believed a negotiated plea will be entered on Ms. Devine's behalf at that time. The charges against the Ketchums were dismissed after the state determined that it could not be proved beyond a reasonable doubt that the baby's death resulted from long-term malnutrition. Tlie state based its decision on two pathologists' reports. The baby died at Ms. Devine's home on Streit Road near Harvard while under her care in February, 1982. Floro said that when the first pathologist's report was issued, the state believed there were grounds for prosecution. However, the McHenry County Mental 708 Board commissioned a private in­ vestigation by a renowned^ pathologist from Minnesota. His report disagreed with the conclusion of the original autopsv- The 708 board report was made available to prosecutors, who then called in a third pathologist, who eventually agreed with the second. The third pathologist was Dr. Helen Young, who testified for the state in the Larry Riley and Charles Albanese trials. A coroner's jury ruled that the death was the result of "gross negligence," and Ms. Devine and the Ketchums were later indicted on the charges. The three defendants had pleaded not guilty to the charges. the Ketchums fled from McHenry County in the summer of 1982 with their 3-year-old son, Christopher, following the grand jury indictments. They were arrested in Rapid City, S.D., waived extradition and, were returned to Illinois. After a custody hearing at the MoH^nry County Courthouse, Christopher was handed over to the custody of the Illinois Depart rnent\ of Children and Family Services. The 708 boaJ$i also conducted an investigation of the DCFS case report concerning the Ketchum incident. Sources close to the DCFS report said in summer 1982 that the report was "grossly inaccurate and in­ complete" and unfairly placed blame for the death. That report was used as evidence by the McHenry County grand jury that indicted the Ketchums and Devine. DCFS officials denied, the allegations. The 708 board cited concern with the "completeness and factualness" of the DCFS field report as the reason for conducting its own probe of DCFS case reports.
