Five percent of the total purchases, excluding tax, will be donated to the McHenry County Senior Citizens' Council. TTie monies will be used to improve the I & R, nutrition, social services and tran sportation programs throughout McHenry County. Hie Supreme Court will hear the appeal during its June term. Verdung indicated earlier that, under the original ruling, McHenry County would be required to rebate $1.2 million to local taking bodies. In a prepared statement this week, Verdung said the court's decision comes "to the aid of taxpayers of McHenry County." "Hie burden of repayment of more than $1.2 million of prior interest money would be placed squarely on the taxpayers," Verdung said. "They would be forced to replace revenues lost by the county's general fund. "But they would probably not benefit from any decrease in taxes by local governing bodies who may treat this rebate as a one-time windfall," Verdung said. "It could very well result in a tax increase without an increase in service," he added. Verdung said that, in reconsidering its decision, he believes the Supreme Court "has recognized the serious financial dilemma that would face all counties in the state of C7T • i ® Crungj? Illinois. The existing appellate court ruling would force county governments to pay more than $200 million in retroactive in terest earnings. In my opinion, that places an unfair and un wantfd burden on taxpayers " The appellate c^urt ruling set a precedent which officials indicated would hurt several counties in the state that did not have enough funds to cover expected rebates. Verdung indicated previously that McHenry County had sufficient cash reserves to cover the rebate to local taxing agencies but noted it would put "fin awful dent" in the county's $19 million budget, which ^received the interest money for use for general operating ex penses. v A similar class-action lawsuit, filed against 97 Illinois counties, including McHenry County, is still pending in Sangamon County. Legislation has been in troduced in the General Assembly which would require local governments to lower their tax levies by the anlounts they receive as interest rebates.
