Under the settlement, attorney Franz will receive $25,000 in compensation for slanderous statements made by Hinebaugh during a 1980 Crystal Lake council meeting on a proposed development on the vacant former Illinois In­ stitute of Technology property on U.S. 14. Hinebaugh charged that "lies have been told" and that Franz allegedly tried to hide details about a subsidized housing project. Hinebaugh, saying he has not been actively involved in the case for the last two years, said the agreement was proposed by the city's insurance carrier. "I didn't want it settled out of court. I would have preferred to see it go to a jury because I trust a jury made up of average citizens," Hinebaugh said. McHenry County Circuit Judge Roland Herrmann ruled in January that Hinebaugh had slandered Franz, eliminating the need for a trial to determine that issue. The judge granted a motion by Franz for a partial summary judgement based on overwhelming evidence that the slanderous statements were made with reckless disregard for the truth. Damages were to be determined by a jury at a later date. _ denied a subsequent motion by Hinebaugh to dismiss the lawsuit baaed on his immunity at a public of* fidal. The former councilman argued that statements he made in his role as tfdty official were absolutely privileged and that he could not be sued for them. At the time Hinebaugh made his allegations, Franz was representing developers of the controversial Commons project, a residential and commeridal plan for the IffMcn HT property. Hiiwthsiiigh accused Franz of lying to Urn and the Crystal Lake zoning board and that he had deliberately kept details of the subsidized housing portion of the development from the project. At a June 1960 council meeting, Franz said there would be no subsidized mutli-family housing atihe project other than a proposed five-story apartment building for the elderly. Developers had applied two months earlier for a grant from the U.S. Department of Housing and Urban Development for low-income family and elderly housing subsidies.
