On Feb. 7, Associate Judge William Homer ruled that a Crystal Lake woman had violated the law when she failed to strap in her 3-month-old child while driving her husband's car. A lawyer for Kimberly A. Beirau, 969 Golf Course Road, disagreed with the ruling and asked Homer to reconsider his decision. According to the restraint law, which took effect July 1, 1984, children younger than age 4 must be strapped into a child seat that is fastened to the car's seat belt. The law applies to parents or guardians while they are driving their own vehicles. Failure to comply can result in a $25 fine and court costs. The title to the car Beirau was driving when she was ticketed is in her husband's name, not hers, attorney Harold McKenney argued. Thus, she cannot be cited, he said. Homer could not be reached for comment. McKenney said that Homer agreed to reconsider his decision. "The judge felt the word 'owner' could mean more than the title owner, but the judge said he is having the matter researched," McKinney said. He refused to comment further on the case. In the meantime, Beirau has refused to pay $53 in fines and court costs. Beirau, 21, was ticketed by Crystal Lake police after she was involved in a two- vehicle accident on Oct. 19,1984, at the intersection of U.S. 14 and Dole Avenue. Beirau, her son, David, and her 20-year-old sister, Robin Macheroux, were transported to Good Shepherd Hospital, Barrington. David was not in jured, and his mother was treated and released. Macheroux, Beirau said, is still recuperating from injuries sustained in the accident. The second car's driver was charged with a stop light violation, police reports state. brothers and two sisters.
