Mayor says no racial remarks made at council meeting town bylaw. The Dhaliwals have two pillars â€" which act as pedestals for lion statues â€" encroaching on the town‘s road allowance at the entrance of their property. The Dhaliwals, however, appealed the decision and were granted a new trial. The Sikh couple says the charge is discriminatory and violates the Charter of Rights and Freedoms. Under oath, defence witness Kevin Flynn, an Oakville regional councillor, told the court the racial remarks were made prior to a Dec. 17, 1990 meeting at which the Dhaliwars were schedâ€" uled to make a request for an encroachment agreement. Flynn was testifying during the secâ€" ond day of a twoâ€"day trial at Oakville provincial offences court. Justice of the peace Carole Starr adjourned the trial until May 21st, at which time she will render her decision in the case. In the meantime, counsels for both sides will make written submissions to the court. "Council members were making ethnic jokes," Flynn said, in response to a question from defence counsel Gordon Crann, who asked the councilâ€" lor if the remarks were made "in a humorous sort of fashion." When asked by Crann what his reaction to the racial remarks was, Flynn replied: "I was trying to get (council‘s) support of my constituents. I didn‘t see any means of furthering that case by involving the other council members on my own true feelings. I left. I didn‘t answer." When Flynn was asked by Crann if the "ethnic jokes" could have influâ€" enced council‘s decision in any way, he replied: "If you‘re asking me ‘If any of the remarks which were heard may have influenced the decision?" I would have to say ‘no‘. But it did cross my Flynn described the couple‘s case as "the least intrusive encroachment I‘ve ever seen since I‘ve been on council. When asked directly if he thought that race was a factor in council‘s final decision, Flynn replied: "No. I can‘t prove that. But there‘s a certain sensiâ€" tivity I have towards the racial issue just being a politician. To hear â€" not jokes â€" jocular remarks of a racial nature from fellow councillors, I don‘t know if it influenced their decision. I did hear (the remarks) and it did enter my mind (that it could influence their decisions)." Flynn also agreed with Carr‘s stateâ€" ment that "As a councillor you bring to bear every consideration you can to represent the best interest of your conâ€" stituents and other councillors try to do the same thing" In a surprise move following the lunch break, Carr called Mayor Ann Mulvale to the stand to refute testimoâ€" ny by Flynn. During questioning by town proseâ€" cutor Doug Carr, Flynn said he couldn‘t recall whether he had been one of the dissenting votes in the Dec. 17th debate. He conceded, however, that he "was on the side (of the debate) that lost." seemed to be a neighborhood dispute that had gotten out of hand," explained Flynn, who represented Glen Abbey residents prior to the town adopting the sixâ€"ward system. "Do you recall any comments of a racial nature by town staff or councilâ€" lors?" Carr asked the mayor. "Not at council. I would not allow it. I did not discuss the matter with council prior to the meeting. But I can assure you that town staff handled the matter in a very professional way," the mayor said. When asked if "race" was a factor in the deliberation of council, Mulvale replied: "My councils past and present are not racist. Their individual and perâ€" sonal heliefs I have no way of knowâ€" ing. Because we have a bylaw and it results in a complaint, we handled it as any other (complaint)." When questioned by Crann whether she was testifying to whether any racial remarks were made during the Dec. 17th council meeting, Mulvale replied: "And further, no racial remarks were arcade R.R.S.P., R.R.IL.E, R.E.S.P. sound systems Sponsored by The Canadian Association of Neuroscience Nurses Drop in and see us, the coffee is always on.
