The condominium has to be "registered" and until this is done, title to the unit cannot be conveyed to a purchaser. In order to have a condominium registered a lot of documentation has to be completed. One of the most important documents is known as the "Declaration". The declaration is the bible of the condominium and also results in the creation of the condominium corporation. .. The primary features of the declaration are as follows: (a) It will set out the number of units in the condominium. (b) It will fully describe the boundaries of the units. (c) It will set out what areas of the condominium are for the exclusive use of the unit owner and which areas are for the general use of all owners. (d) It deals with the issues of parking and locker spaces (note: this part should be checked very carefully by your lawyer because there are a number of ways that parking and locker spaces can be dealt with in a condominium declaration. (e) It outlines common expenses. The declaration has to specify and define the expenses involved in performing the duties and obligations of the condominium corporaâ€" tion as well as any other expenses which the Declaration or the Condominium Act defines as common expenses. (f) It defines what the common areas are. (g)It provides for any restrictions on dealing with the unit which may include restrictions on the uses of the unit, on pets and may even restrict the ability of the unit owner to lease vut the unit. This portion should be very carefully reviewed by your lawyer to make sure that the unit is compatible with your needs. (h) The Condominium Declaration also details what is included in the Common Expenses. Some items that may or may not be included in the Common Expenses. It is important to know which utilities are bulkâ€" metered and which are paid individually by unit owners. Included in this information is a statement or a budget for the first year following the date that the condominium is regisâ€" tered. The Condominium Act provides that for every agreement entered into after June 1, 1979, the agreement is not binding on the purchaser until the declarant delivers to the purchaser a disclosure statement. The Act goes on to indicate that once you as a purchaser have received a disclosure statement, you have 10 days in which to cancel (with certain limitations). These are critical dates for you and your lawyer to be aware of because they afford you in some instances an opportunity to reâ€"negotiate a portion of the deal. In summeary, it is clear that if you are considering a purâ€" chase of a condominium unit or townhouse, you should be prepared and seek legal advise prior to entering into the contract. which have been commenced with respect to common expense arrears. It also sets out the exact amount of the common expenses for the particular unit you are interestâ€" ed in and lets you know when the last payment was made and when the next payment is due. BUYING FROM A BUILDER When you buy from a builder, very often the building has yet to be built or is under construction. This changes things somewhat in terms of buying and there are some advantages available to a purchaser. The government has to approve the proposed declaration and description plan before it can be registered. They cannot approve these documents until all the units in a new building have reached a certain level of construction such that they are ready to be occupied. Because of this, the system is set up so that there are actually two closings on a condominium purchase; (i) an interim closing and (ii) a final closing. When you enter into an Agreement of Purchase and Sale for a condominium from a builder, you should receive a variety of documentation which, by law, has to include a "Disclosure Statement." The interim closing occurs when the building is ready to be occupied and the final closing occurs when title can be transferred. On the interim closing you will be required to pay a monthly occupancy fee which is equal to the common expenses and interest payments on the mortgage as set out in the Agreement of Purchase and Sale.
