In the decision, the hearing officer says all the board was left with after hearing the MNR's extensive evidence was "suspicion and innuendo." "To describe the evidence of the MNR as thin would be an understatement. There was never any evidence presented by the MNR that any of the material placed on the site had had any negative environmental consequences," the decision says. "The conduct of the MNR throughout this hearing had the demonstrable appearance of a single-minded intent to deprive a small and relatively unsophisticated operator of its livelihood for the simple reason that it was difficult to regulate this smaller operator." The board also claims that the Region put forward witnesses who failed to provide unbiased professional opinions, didn't properly assess the case in a way that advanced the public interest and "pursued the case in complete disregard of the cost consequences of so doing for both the licensee and the taxpayers of the region." But Floras said the position the Region advanced at the hearing was "very credible and defensible." "We put forward compelling evidence before the board and it wasn't accepted," he said.
