STUDY COMMENCEMENT AND PUBLIC INFORMATION CENTRE #1 May 6, 2009 ­ 4:30 p.m. to 7:30 p.m. (drop in style) Town Hall, 1225 Trafalgar Road, Engineering Boardroom, first floor Oakville Transit Bus Garage Construction Environmental Assessment and Preliminary Design This is the first of two Public Information Centres planned for the Environmental Assessment. This is an opportunity for residents to drop in and get information on the planned expansion. Town of Oakville Council approved, in principle, the 2007 Transit Facilities Strategy, and the Town has now retained Giffels Associates Limited / IBI Group to prepare the Oakville Transit Bus Garage Environmental Assessment and Preliminary Design. This strategy identifies a need to acquire a new site and construct a new single facility that provides all essential functions including administration, operations, maintenance and storage. The preferred new location is at 430 Wyecroft Road in the town's central industrial area south of the QEW. The ability to maintain existing service quality is being compromised and there is no opportunity for further growth of transit services at the current location. The 2007 Transit Facility Strategy emphasises the need to commence the design and construction of the facility subject to budget approval. Funding has now been allocated by Town Council for land acquisition, project planning and design. The Town must complete an Environmental Assessment for transit projects before constructing the planned facility expansion. Any environmental impacts of this planned facility expansion on the study area are being assessed in the Environmental Assessment in accordance with the transit project assessment process required by Ontario Regulation 231/08. NOTICE OF INTERIM CONTROL BY-LAW PASSING Interim Control By-law - Power Generation Facilities Town Initiated ­ Town Wide, File: 42.03.81 TAKE NOTICE that Oakville Council passed Interim Control By-law 2009-065, under Section 38, of The Planning Act, as amended on the 30th day of March, 2009. The Purpose and Effect of Interim Control By-law 2009-065 to prohibit power generating facilities with capacities greater than 10 MW on all lands zoned E1, E2 and specific T1 zones. These amendments apply town wide. At this time there are no relevant applications, under the Act, pertaining to the subject land. Any appeals of the interim control by-law must be filed with Cathie Best, Town Clerk, 1225 Trafalgar Road, P. O. Box 310, Oakville, ON L6J 5A6, setting out the reasons for the appeal together with a certified cheque or money order in the amount of $125.00 payable to the Minister of Finance for each appeal. A copy of the appeal form is available from the OMB website at www.omb.gov.on.ca. Only individuals, corporations and public bodies may appeal an interim control by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. Notwithstanding the permitted uses and regulations of By-law 1984-63, no person shall use any land, building or structure, or expand any use on the land, or use or erect any building or structure including any addition for the purposes of a power generation facility with capacity of greater than 10 megawatts. 4. By-law 1984-63, as amended, is hereby amended by adding a new subsection (8i) to Section 90A as follows: Special Applies to By-law Provision /Location Number 8(i) 2009-065 Interim control of power generation facilities on the lands identified in Schedule A1-A24 to By-law 2009-065 Pending the repeal or expiry of By-law 2009-065, the lands to which By-law 2009-065 applies may be used for the uses specified in By-law 1984-63 except for those uses specified in By-law 2009-065. 5. This By-law shall come into force and effect immediately upon its passing and shall be in effect for a period of one year from the date hereof, unless extended or repealed in accordance with the provisions of the Planning Act. 6. Schedules A1 to A-14, inclusive, and Schedules B1 to B-14, inclusive, form part of this By-law. WHEREAS Section 38 of the Planning Act , R.S.O. 1990, c. P.13, as amended, authorizes the council of a municipality to pass an interim control by-law where the council has directed that a review or study be undertaken in respect of land use planning policies in the municipality, or in any defined are or areas thereof; WHEREAS on February 17, 2009, the Council of the Corporation of the Town of Oakville passed a resolution directing that a review or study be undertaken in respect of land use planning polices relating to power generation facilities; Council enacts as follows: 1. Notwithstanding paragraph 2, this By-law applies only to the lands identified in Schedule A1 to A-14, inclusive to this by-law. 2. By-law 1984-63, as amended, is hereby amended by deleting Maps 91(4), 91(5), 91(6), 91(7), 91(8), 91(9), 91(10), 91(13), 91(14), 91(15), 91(16), 91(17), 91(23) and 91(24) thereto and replacing them with the Maps 91(4), 91(5), 91(6), 91(7), 91(8), 91(9), 91(10), 91(13), 91(14), Mayor Burton Kim Galione A/Clerk
