The updated bylaw, which was recom- mended for approval by the committee on Tuesday, states that no person shall dis- charge a firearm or bow within the Town of Oakville. The approved exceptions to this bylaw include: A peace officer in the lawful perform- ance of their duty. A person legitimately in a facility oper- ated by or for a regional, provincial or feder- al police force. With Town approval, a person firing blank ammunition for or in connection with its lawful use in a motion picture, television or stage production, historical re-enact- ment or display, a police-sponsored educa- tional program, starting or controlling a sporting event or in connection with special honour guard tribute by the Royal Canadian Legion or similar community-based event. An establishment or business providing paint ball gaming within an enclosed building at a location zoned for the purpose. A person discharging a long-bow for target practice provided that the practice is in conjunction with and under the direct sponsorship of a school board. A person discharging a firearm, provid- ed that person is the lawful owner or occu- pier of the property zoned as Agricultural or Parkway Belt Agricultural, in order to scare or destroy animals that are found in the act of killing or injuring livestock or poultry and/or destroying property or farm produce. In his report to the committee, Assistant Clerk Phil Bouillon said Town staff consulted with the Halton Regional Police Service, the Oakville Rod & Gun Club, the Ministry of Natural Resources and the Ontario Federation of Anglers and Hunters. Bouillon said the Halton-Peel Supervisor with the Ministry of Natural Resources Aurora office John Almond voiced concerns about any prohibition related to hunting. He said the ministry encouraged hunt- ing as a means of managing the local wildlife population while at the same time helping reduce damage to farmers crops, livestock and poultry. Bouillon said the ministry representative also pointed out the increased predation by coyotes and the risk this presents to small children and household pets. The Oakville Rod & Gun Club requested that the existing bylaw be relaxed to accom- modate hunting and that farmers be allowed to utilize an agent to assist with the destruction of nuisance wildlife. The Ontario Federation of Anglers and Hunters also indicated support for regula- tions that would permit limited hunting. Bouillon said Halton police are not in favour of any additional exceptions. In the end, Town staff did not recom- mend adding any kind of hunting provision to the updated bylaw with Bouillon stating that doing so would not be practical. The only land that would be available that might even possibly support some level of hunting would be the lands north of Hwy. 5 (Dundas Street) and thats going to be developed and other parts are going to become a Natural Heritage System, he said. I just dont see that as a hunting ground so accordingly we have not given any rec- ommendations for increased exemptions. Anyone who violates the bylaw will receive a fine of no less that $250 and no more than $5,000 for the first offence. A second offence could result in a fine as high as $10,000.
