Star Oak submitted its sec ondary plan and a collection of background reports to the Town on March 5. Cheeseman told The Oakville Beaver that the back ground reports are complete -- including even a subwatershed study. The Town has claimed in other instances that outstanding reports from a developer have made an application incomplete and therefore no planning stand could be taken on it. Cheeseman said Star Oaks' submission couldn't be consid ered incomplete. "The Planning Services Department welcomed the landowners' submission and indicated that it would be processed concurrently with the Town-initiated secondary plan." stated Cheeseman. Then, on Sept. 13. Town Council passed the Interim Control By-law for parts of north Oakville. Star Oak contends that the Town has made little,progress on its application and has fur ther complicated the situation with passage of the by-law that could further delay develop ment. "The combination of the lack of any meaningful progress in the processing o f the landowners' Official Plan amendment application and a potential two-year delay before Oakville Council may adopt the Town's own secondary plan provided the impetus for Star Oak Developments' decision." said Cheeseman. On Nov. 15. Cheeseman. filed a letter of appeal on behalf of Star Oak with the Town Clerk requesting that the landowners' application to amend the Town's Official Plan be referred to the OMB for adjudication. "Star Oak Developments is optimistic that the OMB prehearing process in the months leading up to a hearing will pro vide the opportunity for dia logue with the Town and agen cies to find reasonable solutions to secondary plan issues," stat ed Cheeseman in a release issued this week. The Town Clerk must now forward the appeals to the OMB and the OMB must begin its process of dealing with the appeals. Cheeseman said it's not known when pre-hearing dates will be set. The Town was aware that some north Oakville landown ers were disgruntled when it decided earlier this month to hold fast to its year-long freeze on development north of Dundas Street. The freeze was passed so the Town would have ample time to further study development in north Oakville. While the Town enacted the interim control by-law for one year, and staff has reported it expects to have information back to Council well within that time (Tame, there is provision for the by-law to be extended for a second year. After two months of discus sion with north Oakville landowners, as follow-up to passage of the by-law, council did not reconsider the by-law and was aware some property owners were not content. Lawyer Lyn Townsend Renaud appeared before coun cil to say NOMI wasn't happy and wanted to see the Town repeal the by-law on all lands except those of concern, so it wouldn't end up stalling the progress of the NOSP. The NOSP is under way refining details of growth to be allowed after Official Plan Amendment (OPA) 198 ear marked north of Dundas for urban development. The purpose of the freeze is to further study the area so inap propriate development doesn't occur. Planning and Development Commissioner David Cash advised council that to proceed properly, the Town should not remove any property from the interim control by-law. Cash said a report is expect ed in March. During the year, the Town will spend $75,000 to further study the area and hold public workshops on the same. Other landowners that expressed dissatisfaction with the development moratorium included K»$Hr-- Christian CaUegMMc private Christian school which had a major expansion set to get started this month -- an expansion that has been in the works with the Town for more than a year, and one that was planned for since the school opened in 2001. Other, dissenters included the VaiwHnnjV.uLUiathi T.nnpUthat wants to build a small med itation hall and Imperial Oil (ESSO) that wants to redevelop the northwest comer of Dundas Street and Trafalgar Road. The freeze affects land abut ting Trafalgar Road, Bronte Road (Regional Road 25); Dundas Street -- from Bronte Road to Ninth Line -- and the intersection of Bumhamthorpe Road West at Fourth Line.
