On Nov. 10, the Town received an applica tion from Glen Abbey owners ClubLink to redevelop the golf course property into 3,222 residential units, 121,000 sq. ft. of new com mercial space and about 124 acres of perma nent, publicly-accessible green space. The presiding member of the hearing is Bruce Krushelnicki, executive chair of the Environmental & Land Tribunals Ontario (ELTO). There are three parties involved - Town of Oakville, ClubLink and Halton Region. The Town' s legal counsel is John S. Doherty, of GowlingWLG, ClubLink Corporation ULC, and ClubLink Holdings Limited' s representa tion is Mark R. Flowers, of Davies Howe Part ners LLP, while Isaac Tang, of Borden Ladner Gervais LLP, is there on behalf of Halton Region. The hearing will call upon four witnesses in total: Town of Oakville - Mark Simeoni, Town director of planning services, who began his testimony Monday, and David Butler, land use planner. Clublink - Mark Bradley, land use planner. Halton Region - Curtis Benson, Halton man ager of community planning. In the opening remarks, Doherty said the in terim control bylaw is a "breathing space.. .as a pause in essence" to allow Oakville to rethink its land-use planning policies. "The Town has a duty to its citizens to ensure that the development of the scale that is con templated by this new development proposal does not have detrimental consequences to the community," said Doherty. ClubLink believes the Town has not acted in good faith by passing the bylaw, as it "unfairly" targets Glen Abbey lands, Flowers told the hear ing, noting it wants the repeal of the bylaw in its entirety upon the hearing' s conclusion. "This bylaw is nothing more than an attempt by the Town to delay and an attempt to ulti mately frustrate ClubLink' s redevelopment pro posal," said Flowers. Tang called ClubLink' s proposal an "un planned, unexpected and unpredictable devel opment." "These were never lands that were never, in the history of the Town' s OP (Official Plan) or in the Region' s OP, identified as a growth area or intensification area," said Tang. Has the interim control bylaw been passed in an attempt by the Town of Oakville to delay and/or frustrate applications for the proposed redevelopment of the Glen Abbey Golf Club lands? 5. Has the Town of Oakville acted in good faith in passing the interim control bylaw? 6. Should the interim control bylaw be re pealed, either in whole or in part?
