The purpose of the zoning by-law amendment is to add provisions to Zoning By-law 2014-014 (South of Dundas Street and North of Hwy 407) and Zoning By-law 2009-189 (North of Dundas Street and South of Hwy 407), to permit and regulate short-term accommodations and to modify regulations for bed and breakfast establishments. The amendments would align with the proposed by-law to licence, regulate and govern short-term accommodations and bed and breakfast establishments. The effect of the amendment to Zoning By-law 2014-014 includes changes to: • Add a definition for "short-term accommodation"; • Add regulations for short-term accommodations including a requirement that a short-term accommodation only be permitted in a principal residence and require a parking space; • Permit short-term accommodations, subject to obtaining a licence, within residential low zones, residential uptown core zone, residential medium zones, residential high zones, mixed use zones, and accessory dwellings; • Prohibit short-term accommodations within the same dwelling as a bed and breakfast establishment, a lodging house, private home day care, and day care; • Amend the definition of "bed and breakfast establishment" to recognize the provision of lodging units for a bed and breakfast is to occur within a dwelling; • Amend the definition of "lodging unit" to recognize that they may contain bathroom facilities; and, • Amend the regulations for bed and breakfast establishments to permit three lodging units within a bed and breakfast establishment, up from two, and associated floor area regulation. The effect of the amendment to Zoning By-law 2009-189 includes changes to: • Add a definition for "short-term accommodation"; • Add regulations for short-term accommodations including a requirement that a short-term accommodation only be permitted in a principal residence and require a parking space; • Permit short-term accommodations, subject to obtaining a licence, within Urban Core zones, Neighbourhood Centre zone, General Urban zone, Sub-urban zone, High Density Residential zone, and second suites; • Prohibit short-term accommodations within the same dwelling as a bed and breakfast establishment, a lodging house, private home day care, and day care; • Amend the regulations for bed and breakfast establishments to permit three lodging units within a bed and breakfast establishment, up from two, and associated floor area regulation. In addition to the Zoning By-law Amendments, a Licensing By-law to licence, regulate and govern short-term accommodations and bed and breakfast establishments will also be presented at this meeting, to be passed under the Municipal Act. If a person or public body does not make oral submissions at a public meeting, or make written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk's department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at townclerk@oakville.ca before the zoning by-law is passed: a) the person or public body is not entitled to appeal the decision of the Town of Oakville Council in regard to the zoning by-law to the Ontario Municipal Board; and b) the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. Any submission to the Planning and Development Council, either in hard copy or in electronic format, must be forwarded to the Clerk's department for receipt no later than noon on March 19, 2018, to ensure its availability to the Members of Council at the meeting. Individuals making oral submissions at the public meeting are requested to submit a written outline of the submission to the Town Clerk. All submissions should include the full name and address of the presenter.
