Forensic toxicologist Inger Bugyara took the stand in a Burlington court on Wednesday, June 1, the fifth day of the trial of Kev- in Hyde, 59. She told the court she conducted an analysis of a sample of Hyde's urine, which was sent to the Cen- tre for Forensic Science by Halton police. Bugyara noted in her March 2021 report that while the urine contained carboxy-tetrahydrocan- nabinol (THC), a metabo- lite of the active ingredient of cannabis, the analysis was unable to determine how much cannabis Hyde took, how he consumed it, when he consumed it or if he was impaired. Hyde was compelled to submit a urine sample to Halton police after the car he was driving fatally struck speech and lan- guage pathologist Louise Whiten, 51, and her dog Zack on Dec. 3, 2020. The Oakville man was arrested at the scene of the crash, which occurred on Lakeshore Road near Bur- gundy Drive, and charged with impaired driving causing death and danger- ous driving causing death. He has pleaded not guilty. When asked by Assis- tant Crown Attorney Mi- chael Godinho about the impact cannabis impair- ment can have on driving, Bugyara noted people im- paired by cannabis have decreased reaction time and can have issues with focusing and concentrat- ing. She said a vehicle weav- ing along the road is a com- mon sign of a driver who is impaired by cannabis. When asked if this type of impairment could cause someone to leave the road- way, Bugyara said it was possible. On Tuesday, May 31 the court heard from Const. Kimberlee Newton, who testified she searched Hyde's car after the acci- dent and found a small bag- gy containing marijuana in the trunk. She also said she detec- ted the faint odour of "burnt cannabis" inside the vehicle. A cigarette found on the driver's side floor was found to be just a tobacco cigarette. Defence attorney Dean Paquette pointed out the cannabis was located in the trunk, out of the driver's reach. He questioned Newton's recollection of smelling "burnt cannabis" in the ve- hicle as she had not listed this in her notes of obser- vations taken from the scene.
