John Sandfield Macdonald. _ SPRING ASSIZES, LORIGINAL Ajury having been sworn the facts of the case were briefly detailed by Mr. Scott. The deceased came into the Tavern of John Berâ€" geron in the willage of Hawkesbury, on the 11th of April last, and the deceased taking adâ€" vantage of a temporary absence of the accused from the bar at which he was bar keeper, went behind the bar and filled out a tumbler of gin which be drank off. The prisomer came in and accused him ofthe theft when deceased denied it and called him a liar, on which the ‘prisoner struck him in the face dragged him from behind the bar and knocked bim lit_ï¬n( on & sofa in the room, and again struck him, the prisoner‘s brother interfered and told him to put him out quictly, and he then dragged him to the door, and it is stated gave him two kicks one. of which was given as he was pushed out the door. The man went home, complained of the injuries inflicted, Doctor Roberts was sent for the same evening, and the man died about seven u‘clock the next mornâ€" ing. _ A post mortem examination showed that the cause of death was a rupture of the duodenâ€" um with which, according to the medical tesâ€" timony, be could not have lived more than twelve or fifteen hours after the injury was reâ€" received. * We gave in our report of the inquest a full abstract of the evidence, and the same witnesâ€" ses were now examined, and deposed to the same facts, the witness Marion ~Morris on her crossâ€"cxamination stated that she had seen the prisoner in the bar room in the morning between nine and eleven, and he was moaning ingrwpdnhndmbflnnhh-wwh,ï¬o.d- dressed him in both English and French, but he was unable to reply, and leftâ€"she saw him qdniuuu:ewnin‘junub-wuwlofld the bar by the prisoner, but as she was behifd him she did not see how he was. l The Hon.
