I EXTRACTS FROM STATEMENT OF CLAIM 1. The Plaintiffs Steven French, born on the 7th day of February, 1972, and Robert William French, born on the 27th day of June, 1975, are infants residing in the Town of Collingwood, in the County of Simcoe, with their mother and next friend in this action, the Plaintiff Norma French. At all material times the Plaintiffs were passengers in a motor vehicle which was owned and being operated by their father and husband, respectively, Dennis.French, who was fatally injured when-invotved-in-the collision as-hereinafter mentioned. 2. The Defendant Dynes resides in the Town of Elmvale and the Defendant Jordan resides in the Town of Wyevale, both in the said County of Simcoe, and at all material times, they, or either of them, were the owner of a 1966 Pontiac motor vehicle, the 1976 Ontario Licence of same being AHN 813. The Deceased Murdoch resided in Glen Huron, in the Township of Nottawasaga, in the said County of Simcoe, and at all material times was the operator of the said motor vehicle. 3. On or about the 28th day of May, 1976, the Plaintiffs, motor vehicle was proceeding in a southerly direction on Highway No. 24, in the Township of Nottawasaga, in the said County of Simcoe, at or near a point approximately two miles north of Singhampton Corners, when it was struck by the motor vehicle of the Defendants, owned and operated as aforesaid, which was proceeding in a northerly direction on the said Highway 24. 4. As aresult thereof, the said Dennis French sustained serious injuries resulting in his death on the said 28th day of May, 1976. 5. The infant Plaintiff Steven French sustained injury more particularly described in the Statement of Claim, filed. 6. The infant Plaintiff Robert William French sustained injury more particularly described in the Statement of Claim, filed. 7. The Plaintiff Norma French sustained injury more particularly described in the Statement of Claim, filed. 8. The Plaintiffs allege that their injuries, loss and damage were caused by reason of the negligence of the Defendants, such negligence consisting inter alia, as follows: (1) The Defendants Jordan and/or Dynes permitted their motor vehicle to be operated by an incompetent driver lacking in reasonable care, skill, ability and training; (m) They or either of them permitted their motor vehicle to be operated when they knew, or ought to have known, that the same was not in a fit and proper mechanical condition. 9. The Plaintiffs were dependant on the late Dennis French for financial assistance and by reason of the aforesaid negligence which caused the death of the said Dennis French have sustained and will continue to sustain pecuniary loss and damage. 10. The Plaintiff Norma French has incurred expenses for the burial of the said Dennis French and therefore claims the sum of $800.00. 11. The Plaintiffs therefore claim: (a) Damages under The Fatal Accident Act in the sum of Four Hundred Thousand Dollars ($400,000.00) ; (b) The Plaintiff Norma French, damages in the sum of Fifty Thousand Dollars ($50,000.00) ; (c) The Plaintiff Steven French, damages in the sum of One Hundred Thousand Dollars ($100,000.00) ; (d) The Plaintiff Robert William French, damages in the sum of Thirty Thousand Dollars ($30,000.00) ; (e) Their costs of this action; (f) Such further and other pejlet as the nature of this case may require. iy 12.
