WHEREAS by-laws may be passed by a municipality pursuant to Section 354 subsection 24 of the Municipal Act, R.S.O. 1970, for requiring owners of privately owned outdoor swimming pools to maintain fences and prescribing the height and description thereof. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF TAY ENACTS AND BE IT ENACTED AS FOLLOWS:- 1. For the purposes of this by-law the definitions and interpretations given in this section shall govern! (a) SWIMMING POOL A tank or body of water maintained or used or which may be used for swimming and which has a depth greater than twenty (20) centimetres other than a natural body of water, stream, or dammed stream. (b) PRIVATELY OWNED Ownership by a person other than the Province of Ontario or the Government of Canada. (c) PERSON An individual, association, firm, partnership, corporation, trust, organization, trustee or e1ent, and the heirs, executors or legal rep-esenta , of the person to whom the context cam apply | cording to law. (d) A FENCE CONSTRUCTED OF SUITABLE - FENCING MATERIAL is a fence not less than 1.2 metres in height constructed of either of the follow..g materials:- (i) a chain link fence with links not exceeding four (4) centimetres, or (ii) a vertical board and/or picket fence with openings no greater than four (4) centimetres, or (iii) a wrought iron fence with openings no greater than ten (10) centimetres, or (iv) a wall of a building, or (v) an above ground pool, wherein the outside structure of the pool is a minimum of 1.2 metres above ground, and having a gate or gates constructed of the same material and supported by mechanical hinges with self-closing and self-latching devices on the inside of the gate. (e) IN THE CASE OF AN ABOVE GROUND POOL, the outside structure of the pool, being a minimum of 1.2 meires above ground, will carry the effect of suitable fencing material. , 2.No person shall own or use of maintain a privately owned outdoor swimming pool unless the same be surrounded by a fence constructed of suitable fencing material. 3. All persons who own or maintain a privately owned swimming pool shall maintain the gates in a locked closed position at all times, except for those times the swimming pool is under the supervision of a person of not less than sixteen (16) years of age. 4. No person who owns or maintains a privately owned swimming pool shall attach any device for projecting an electric current through or on top of the fence required in Section 2 hereof. 5. This by-law shall come into effect: (i) in respect of all privately owned swimming pools constructed after the date of passage of this by-law, and (ji) in respect of all existing privately owned swimming pools on the 60th day after the passage of this by-law. 6. Any person convicted of a breach of any provision of this by-law shall forfeit and pay, at the discretion of the convicting Justice, a penalty of not less than $100.00 and not exceeding (exclusive costs) the sum of $1,000.00 for each offence recoverable under the Summary Convictions Act, R.S.O. 1970, C. 450, as amended from time to time.
