Haig said he learned by telephone last Friday that the case was dismissed, and that the town's cost of defending the suit has been ordered to be paid to the town by Gostick. Haig said the town's expense is substantial and that the town's bill will be a figure in the thousands of dollars. The bill will be ready in three or four weeks, he said. Haig expects the bill will be referred to a taxing officer, a provincial government employee who will examine the bill, at the request of Gostick, to check that the expenses claimed are reasonable. The town began preparing to defend itself last August. Representatives of each party went to Toronto four times before the case was heard on the fourth trip. Haig had not received the written decision by Monday, but he said it is "'fair to assume" by the fact of dismissal that the justice did not agree that the town harbour committee or the council had acted in bad faith, or discriminated, in its relations with Gostick, or that the commission's procedures were faulty, all charges made by Gostick, Haig said.
