Ted Symons, the town's solicitor, made the recom- mendation in the context of town council-directed research by him into the letting of a contract by the Midland Library board. The contract was award- ed to a member of the library board, Moreland Lynn. The lawyer reached his conclusions and made his recommendations using material provided him by the town council. Coun- cillor Gail Barrie confirm- ed that he was not to seek other information, he notes in his report. "T felt that I should at least speak to the chairman of the library board to clarify some of the unanswered questions that are not fully addressed in the board's minutes but I was instructed not to do so,' Symons wrote. Symons, in the section of his report focusing on the Municipal Conflict of In- terest Act, wrote, "The Act as it stands recognizes that, particularly in a small com- munity, a member of coun- cil or a local board may continue to do business with the municipality or the board in question, pro- vided that the member complies with the Act in disclosing the interest and avoiding any part in the discussion or the voting on the matter in question. The argument. that members should be prohibited from doing. such _ business altogether was rejected by the legislature." "Tt was argued than and still is that the approach is not a good one. Even though a member may comply strictly with the disclosure rules, it is often difficult to avoid the ap- pearance of favouritism -and unfairness to other bidders. However, to ex- clude members entirely from municipal contracts would be to discourage many people from seeking office and participating in local boards which would be a greater disadvantage the smaller the communi- _ ty. It is the latter position that was adopted in spite of the argument on ap- pearances."" "The Act requires a member of a local board who has a pecuniary in- terest in a matter to disclose the interest and then to avoid taking part in the discussion and voting on the issue.
