(1) All charges imposed under this byâ€"law shall be caleuâ€" lated by the Commissioner of Buildings of the Corporation at the time of issuance of the building permit and the Comâ€" missioner of Buildings shall certify the amount of the charge to the Borough Treasurer; (2) All charges imposed under this byâ€"law shall be payable upon the commencement of the erection or enlargement of the building and the Commissioner of Buildings shall give written notice of such commencement to the Borough Treasurer; (3) The Borough Treasurer shail prepare a special roll showing :â€" (1) Subject to Subsections (2) and (3) hereof and Section 5, a charge, for the improvement of storm sewers and sanitary sewers in the Borough of York, is hereby imposed on the owner.or owners of every building in the Borough of York for the erectiom or enlargement of which a building permit is issued subsequent to the date of the passing hereof, of twenty cents (20c) for each square foot of gross floor area of such erection or enlargement as the case may be; (2) Subject to Subsection (3) in calculating the charge under Subsection (1), each building, as described therein, is entitled to and shall be credited with an exemption of 3,000 square feet to be deducted from the gross floor area of such erection or enlargement as the case may be: (3) The exemption granted in Subsection (2) hereof in the case of an enlargement of a building shall apply only to the first enlargement thereof and shall not be granted where there has been an exemption in respect of the initial erection of the building. ‘The Council declares that the buildings referred to in Secâ€" tion 3 bereof may impose a heavy load on the sewer system, of the Corporation by reason of which expenditures may be required to provide additional sanitary or storm sewer capaâ€" city which, in the opinion of the council, would not otherwise be required. * _ â€" > THEREFORE THE COUNCIL OF THE CORPORAâ€" TION OF THE BOROUGH OF YORK ENACTS AS FOLLOWS: â€" (e) (d) WHEREAS‘ Section 379eâ€"of The Municipal Act,â€"Chapter 249, R.S.O. 1960, as amended, provides that with the approval of the Municipal Board, councils of local municipalities may, by byâ€"law, define the class or classes of buildings to be erected or enlarged after the effective date of the byâ€"law that impose or may impose a heavy load on the sewer system or water system, or both, by reason of which exâ€" penditures are or may be required to provide additional sanitary or storm sewer or water supply capacity that in the opinion of a council would not otherwise be required, and may impose upon the owners of such buildings a special charge or charges over and above all other rates and charges to pay for all or part of the cost of providing the additional capacity;: (a ) ‘TO PROVIDE for special charges on buildings which may impose a heavy load on the sewer systent. (b) THE ONTARIO MUNICIPAL BOARD IN THE MATTER OF Section 379e of The Muniâ€" cipal Act, (R.S.0. 1960, c. 249) â€" and â€" IN THE MATTER OF an application by The Corporation of the Borough of York for approval of Bill No. 85, given first reading on the 13th day of March, 1967 and second reading on the 24th day of April, 1967, authorizing the imposition of special charges on buildings which may impose a heavy load on the sewer system.
