Mr Wm Calder was the chairman of the committee and he purchased from the Presbyterian Ch. a gravel pit at the rear of the church tor $125. in the agreement signed by both parties, the county was not to dig closer than 15 feet from the sheds at the rear ot the church or deeper than the depth of the mad beside the pit. From what could be learned from Reeve Bell, the pit had been dug as close in some places as 5 feet from the sheds and had also been excava- ted deeper than meement stated. The Trustees of the church are won- dering whether or not the county are liable tor any damages that may oc- cur. There is a danger now ot the sheds falling down, as the gravel pit is so close and if they do. the church wants to know to whom to so for damages. There was considerable discussion by members of the coun- cil on the question and Reeve Helm the present chairman of the County Roads Com. said he was a member ot that committee in 1921 and had heard nothing of the transaction with the Durham Presbyterian Ch. He said Mr Calder must have signed his name to the agreement without consulting his committee. The re- sult of this information caused more discussion but Reeve Bothweil of Sydenham, moved that the matter should be left in the hands of Reeve Holm. that he investigate and ir necessary have a lawyer say wheth- er or not the transaction was a legal one or not.
