After reciting the facts as to the boy‘s visit to Shelburne, Foster had positively indentifiied prisover as the one who ; purchased a pistol from |Hannab. Frear corroborated Foster in‘ this, that a boy did purchase a pistol on '. that day, but he fmled to recogoize Smith | as the oue who was in the store. AQgr an absence of about an hour the jury returned . to Court. y TBE YERDICT. In anewor to the question, *"Havre yor agreed upon a verdict" ? the foremsan reâ€" plied, "not guilty." There was sensation in Court at tite anâ€" nouncement, and the councel aud friends crowded round to congratulate the pris oner on the successfal issue of the trigl. Justice Osler, addressing the boy, said, "I eannot say but that I agree altpgether withthe verdict. T think the jury could have come to no other conclusion. You are disâ€" charged. The evidence of Hanâ€" nal & Foster as to the boy having bought the revolver in Shelburne between two and throe o‘clock on the Thursday immediately preceding the 21st January, is at least shaken by the aliti sworn to by John Besâ€" P 4+ L Ne deie: ARAEEIW NC 9 We c caiol wl m ley, who gave him a lift on bis way home, so that the boy would le at his uncle‘s beâ€" 1 tore two o‘clock, and consequently unable to be at Hanuahi‘s store between two and three. â€" According to the boy‘s story the old man was shot through the window and fell off the chair, but according to the evidence blood and signs of a violent simggle were found in the rnow near & wood pile. Kither the boy killed the old man by shooting bim first, and then battering him with a birch club, or the old man may have risen to pursue his assailant after the ‘ boy ran away, and have been â€"killed outâ€" right near the woodpile, and then ea.n'ied! back into the house. But why he was not taken inside to be burned is a mystery, as to conceal the crime must bhave been the motive of incendiarism. _ The finding of the cartridge box in the well alongside the path taken from Mr. Watt‘s house to the scene of the murder has a very bad l look. Tt is remarkable that the confession that the witness McCormack attributed to Johnuy Smith should tally so well with the circumstances of time and place of the crime. Crossâ€"exramination fariled to shake the story as related. But on the other hand the man read some at least of the newspapers at the time, and may have had reasous of his own for building a theory on the facts, and claiming the whole to be a confession of the boy. This, at any rate, must have been the view taken by the learnâ€" ed judge who weighed McCormack‘s eviâ€" dence. The indifferent, unconcerned demeanour of the boy bas been a matter ef remmk sivce his arrest, â€" Callousness could hardly be supposed to have gained such an asâ€" cendancy over one so young, and his unâ€" concern may not unfairly be counted a sign of innocence. _ His good character. ;\hithem nuimpeached, is also in his faâ€" vor.
