NOTICE 1I REREBY GIVEN that application bas been made for approval to expropriate the land described in îhe schedule hereto. Any owner of lands in respect of which notice is given who desires an inquiry into w ether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shaîl so notîfy the approving authority in writing. The Expropriations Act provides that, (a) wh ere an in quiry is requested, it shall be conducted by an inq uiry oficer appointed by the Minister of justice and Attorney General; (b) the inquiry office'r, (i) shaîl give every party to the inquiry an opportunity to present evidence and argument and to examine and cross-examine witnesses, either personally or by bis counfsel or agent, and (ii) niay recommend to the approving authority that a party to the inquiry be paid a fixed amount for bis costs of the in quiry not to exceed $200 and the approvîng aut hority may in its discretion order the expropriating authority to pay such cosus forthwith. 2. l"owner'" and . registered owner" are defined in the Act as follows: eowner" includes a mortgagee, tenant, execution creditor, a person entitled to a limited estate or înterest in land, a com- mittee of the estate of a mentally incompetent person or of a person incapable of managing bis affairs, and a guardian, executor, administrator or crustee in whom land is vested; I'registered owner" means an owner of land whose interest in the land is defined and whose name is speciied in an instrument in the proper registry, land titles or sherifî's office, and includes a person shown as a tenant of land on the last revised assess- ment roll; 3. The expropriating authority, each owner who notifies the approving authority that be desires a bearing in respect of the lands intended to be expropriatedl and any owner added as a party by the inquiry officer are parties to the inquiry. U. S. Secretary of Transportation, Claude S. Brinegar, recently said he suspects that before long a few cities "will be looking at the possibility of licensing the use of freeways, with fees higher ... like movie theatres or long distance telephone calîs ... during prime time." The number of motorcycie drivers kiîled in Ontario in 1971 - 72 shows a marked increase over previous years. Statistics recently released show that 65 motorcyclists were killed and 2,463 injured during the period September 1971 to August 1972. This compares with 49 killed and 2,440 injured over the same 1970 - 71 period. The number of motorcycle passengers killed in Ontario last year stands at 16, with 641 injured. Information concerning the cfrcumstances surrounding these fatilities is flot yet available, but a study just eompleted by the University of North Carolina Highway IE Safety Research Centre indicates that in most crashes involving a motorcycle ami an automobile, the driver of the automobile is at fault. 935 motorcycle crashes were studies and researchers found that about two - thirds of the crashes involved more than one vehicle and almost aIl of these involved a motorcycle and an automobile . In 62% of the multi - vehicle crashes, the driver was found to be at fault. In most instances, the car was making a left turn in front of the motorcycle when the collision occured. The car pulling in front of the motor- cycle was the second most frequent contributing cause. The motorcycle driver was at fault in only 29% of the multi - vehicle collisions. According to the study, in most of these cases, the motorcyclist was 'following too close." In single vehicle crashes involving motorcycles, loss of control while rounding a curve was the most frequent cause, occuring in one -t lird of the cases. Loss of control was also caused by pedestrians, animaIs, or bicycles, darting onto the road and by gravel and oil slicks on the road. Very few instances were found where the motorcycle driver was at fault in a single vehiele crash.
