Under Ontario's Sale of Goods Act there is implied in every contract of sale a condition that the goods shall correspond with their description when they are bought by description. Under the Consumer Protection Act a merchant can- not ask you to waive this irnplîed condition. So the term on the order is of no effect. You can return the goods and get back your deposit. You 'are not obliged to pay for goods different from those you ordered. Q. There was an ad in a paper two weeks ago advertising six foot sofas for $38.50. We Phoned thse company, and. they said it was a misprint, and that the ad was sup- posed 10 say $338.50. Could we have made the company seil us the sofa for $38.50 if we wanted to? A: No. In the law of contracts, an advertisement such as this is flot an offer which you can accept 10 form a contract. Rather it is termed an "invitation to treat". A valid contract would not be formed unless the mer- chant offered you the sofa at $38.50 with the intent to formn a contract of sale. Generally in a retail situation, the obligation to seil at a certain price is only arrived at in the store when the sales-slip or order is made out and signed by thc castomer. Q. This year the validation stickers for passenger cars is green in colour and those for trailers are black. Fees are the same as for 1974: $23 for a 4-cyclinder vehicle; $32 for 6-cyclinders; $40 for an 8-cyclinder car and $5 for trailers. This is the second yeaï of the multi-year permit and sticker renewal system. With a view to speedirig up service in thse licence issuing offices, simplified re- newal application forms con- taining an insurance declara- tion have been distributed ahead of time to aIl provin- cial L.C.B.O. retail outlets as well as ail licence issuing of- fices.
