Not llmited to the Pickerng case but generally ap-' plicable as a regulation under the'Expropriation -Act, its en- forcement contradicts what I believe to be the intention of a capital gains tax. Selling under durýess is in -noway com- p arable to willing dispossession' of 'à valuable. propety. *Wbatever the rationale for the practice may be, I feel it to be an inberently mnequltable and unfair pohicy., A number of constituents have spoken to 'me on'this mat- exempt one froin capital gains if it can be shown that the land in excess of one acre was necessary, for the use and en- joyment of the résidence. Revenue then considers, the size and character of the housing unit, the use 'of the landover one acre, prèvincial or municipal zonlng laws aplicable and the like. Furtber, a taxpayer may'defer part or-ail of the tax until a later date under Subsection 44,(1) of the Ex- propriation Act. StiR, such exceptions do flot justify. the tax's application in tbe first place. Tothis end, Il have-begun lobbylng the Minister of Finance, The Honourable.
