NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a By-iaw of The Corporation of the Town of Whitby by the Council thereof as follows: 1. That Section2 of By-iaw No. 258.5 is hereby amended by adding the follow- Ing subsections: (61a) "Pit" meanis a place where unconsolidated gravel, stone, sand, ear- th, dlay, f Ill, minerai or other materiai is being or has been rerroved by means of an excavat.io-n to supply materials for construction, in- dustrial or manufacturing purposes, but does not include a wayside pit. (67b) "Quarry" means a place where consolidated rock has been or is being removed by means 0f an open excavation to supply materiai for construction, industrial or manufacturing purposes, but does flot include a wayside quarry. (83a) "Wayside Pit" or "Wayside Quarry" means a temporary pit or quarry opened and used by a public road authority solely for the purpose of a particuiar prc;ect or contract of road construction and not iocated on the road right of way. (66a) "Public Road Authority" means Federal, Provincial, Regional or Municipal agencies, and includes any commission, board, authority or department established by such agency having juris- diction over a road. 2. Section 6 Section 6 0f By-law No. 2585 is amended by adding the following sub- section: (25) Pits and Quarries The making, establishment or operation of a pit orquarry within that portion of The Corporation of the Town, of Whitby as defined in Schedule "A" to said By-law No. 2585 i3 hereby prohibited. (zgc) "Public Road Authority" means Federal, Provincial, Reglonal or Municipal agencies, and includes any commission, board, authority or department estabiished by such agenoy having juris- diction over a road. (ab) "An Aggregate Storage Area" means an area iocated on a pit or quarry property for the storage of sand, gravel, stone or other material extracted from a pit or quarry. 2. Section 3 Section 3(a)(1) of By-iaw 1784 is amended by adding the following addi- tionai zone: Zone M-4 - Extractive Industriai 3. Section 4 Section 4 of By-law No. 1784 is ariended by adding the foliowing addi- tional subsection: W) Pits and Quarries No person shaîl open, estabiish or operate a pit or quarry within the portion of The Corporation of the Town of Whitby as described in Schedule "B" to the said By-iaw No. 1784, except as expressiy pro- vided for in the Extractive Industriai (M4) Zone of this By-iaw. 4. By-law 1784 is furtheramended by adding the followlng additionai section, namely; Section 9A as foliows: Section 9A Extractive Industrial (M4) Zone (1) Uses Permitted: No person shail within any M4 Zone use any lot, erect, alter or use any building or structure for any purpose, except one or mote of the foiiowing M4 uses, namely; a) Residential Uses: prohibited b> Non-Residential Uses: i) an aggregate storage area; Il) a pit and/or aquarry; lii) a portable processing plant. (2) Zone Provisions: No person shaîl within any M4 Zone use any lot or erect, alter or use any building or structure, including a portable processing plant, or excavate any pit or quarry 6-r maintain any aggregate storage area except in accordance with the following provisions: a) The location of any of the above-mentloned items in relation to the lot lines or any public highway shahl be In accordance with the provisions of The Pits and Quarries Act, 1971 and the regu- lations made thereunder. b) In addition to the above provision: il No building, portable processing plant or aggregate storage area shall be located within 90 metres of any dwelling house on any adjacent lands held under distinct and separate ownership f rom the ownership of the pit property and which dwelling house existed at the date of the passing of this By- law. ii) The maximum height of a portable processing plant shail flot exceed 21.5 metres.
