WHITBY FREE PRESS, WEDNESDAY, MARCH 24,1982, PAGE 19 Too costly to hire planning exzpert, councillors s ay CONT'D FROM PG. 1 motion forward," Emni sald. JRegional Counclilor Tom Edwards came out in support of Emm's position. He said that when deain wih heOntario 'Municipal Board it'is best to have the specialized kind of professional help that Jovial will have. "Yod get the best 'availabie heip" Ed- wards said. "This is not a depar- ture from - anything we've done," he ýcon- tinued, "and it is not a slight to any legai ad- vise we've received in the pat." However; othermcm- bers of council did flot hold this view. West Ward Councillor Joe Bugeili pointed out tha duingthe six cases ~the town has fought beo e e0MB during hi eue on council, th onwon five of them. Be also pointed out ~that the town will have 'to go. to the board on at ;Ueast three cases In the near future. Bugelli also claimed that the board would be satisfied with the town's disapproval of the projeet by the seven to nil vote that denied EMM< Jovial's application. The councillor alIso voiced concern about' the cost of hiring such specialized help. "I don't see a dollar figure cost " he said ad-, ding that the ,town's legal fee budget of $35,000 is, already depleted by $7,700. ."When the next one comes along, what ie it going to cost?" Bugelli added. Council Column WH'bitte by members of Su TOWN COUNC'IL By COUNCILLOR BARRY EVANS Centre Ward Chafrman, Clerk's Depar 'tment The arrivai of spring will herald renewed activity at the Port Whitby Marina. A contract has been let for the construction of more boat slips, and thîs year should see the final levelling and planting of the parklnnd area around the harbour. On the negative side, thîs area wilI probable 'attralct a large number of Canada Geese'such as have made their presence known at Toronto Island and Ontario Place. Moving uptown, we shaîl see the commencement of construction for the new Whitby Tourist Infor- mation Centre to be located at the south-west corner of Burns and Brock Street South. You will recali that we had a tempornry trailer locnted there laet year, and this facillty was a huge success. Further up Brock Street you will note the passing of the South Sens mural on the side of 409 Brock Street South. My criticism of this mural attracted a large volume of comments from our citizenry, nnd I must admit that a significant proportion disagreed with my point of view. In fact, final judgement was handed down by one of our County Court Judges who indicated that the mural was a vast im- provement to the building. An appeni fromn this ruiing is still under consideration by those on coun- cil with good taste. At my Instigation, our sign by- law is being studied to examine the possibility of in- cluding wnll murais ln our definition of sign. The spring should also bring more people out to shop downtown. Those of you who have hibernated in enclosed walls ail winter wiil be piensantly sur- prised to discover the fascinating stores, quaiity nierchandise, and good personal service to be found downtown. This shopping area is slowly evolving to attract a different type of business from that of shopping centres, concentrnting on specialty items and unequnlied service. Further north, council has approved a new con- venience plaza at Brock Street and Manning Rond, lWitb construction to commence this year. Plans of subdivision have been approved between Manning and Rossland Ronds and it is possible that we wili see the start of new houses north of Rosslnnd bet- ween Garden and Anderson. As in 1981, Whltby will continue to be vital and growing lni 1982. To maintain our momentum, we need the heip and optimusm of the entfre town. A symbol of our optimism and energy le out town flower, the Marigold, which soon wili be seen lining the entrance to our town, and bopefully adorning the gardens.of out citizene. Hurray for spring! However, East Ward Councillor Joe Drumm replied: "lWe can't af- ford to lost this one."1 "That is no- place for à Canadian Tire store," hie saîd adding if it was built"lit's, going to be heil."> Opposition to the motion also, came from 'Mayor Bob. Attersley, who, left the chair to speac against it. "I'mi surprised at the members of council for entertaining this <motion," hie said. I'Im appalled at a motion when ther is no dollar sign on it." "It doesn't specify who we should hire,"'I he added. Attersley pointed out that the: 0MB is an im- partial, independant body that makes decisions -based on the evidence presented to it. "I do have soMe failli in the 0MB", hie said adding that the board will be swayed by the seven to nil denial vote. The mayor also believes that if special legal council was retained, the budget would be substantially overspent. "I can assure you that if this motion camres, il will be over $100,000," hie cîaimed. (Area residents have received quotes from legal specialists in thp $5,000 range.) The motion was ls on a recorded vote of, three to three. Tradition dictates that when'a .motion. ,is lied, it is assumed to be lost.
