Council postpones gas.bar decision - Whitby council bas postponed a decision on a gas bar for the soutbeast corner of Dundas St'. W. and Jeffrey St. after concerns raised by two councillors. Administrative committee bad given approval to the gas bar last week. One of the committee's requirements was tbat the developer, Soutbland Canada Inc., was to make improvements to tbe intersection including a median on Dundas and reconstruction of tbe intersection. But councillors Joe Bugelli and Marcel Brunelle opposed the gas bar. Bugelli noted tbat in council's agenda on tbe matter, no opposition was registered at a publie meeting to rezone the property to permit the gas bar. He contended that tbere wias no opposition because no one knew of the meeting. The Town's bylaw stipulates that peoperty owners and tenants within 400 feet of a rezoning application must be notified of a public meeting. But Bugelli questioned the wisdom of the bylaw noting that "9not many people" live witbin 400 feet of the property. He also questioned the Towns decision to permit a gas bar at the intersection when he claimed that witbin a year there wiIl be tremendous pressure to realign Jeffrey with D'HiEllier. "To* give away that parcel of land would be wrong," said, Bugelli. Councillor Brunelle opposed the gas bar, saying he felt Whitby "bas enough bas bars. "Every time we, create an intersection with lights, gas stations start te pop up around it like mushrooms," said Brunelle." He noted that under the Municipal Act the Town can say "ine" to a gas bar and not face an appeal at the Ontario Municipal Board. "What we need to decide here is if we need another gas bar at that intersection," said Brunelle. Council decided to refer the application back to committee after Bugelli pointed out that the committee's report did not state whe would bear the costs of improvements to the intersection. It could cost $500,000. Who knows?" said Bugelli. But councillor Ross'Batten, a member of the committee, told Bugelli it was understood at the committee level that the developer would assume the cost. The main concern from the, public works department relates to cars turning Ieft into the gas bar from Dundas St. "The public works department considers traffic turning movements at the JeffreylD'Hiller/Dundas -St.' intersection hazardous. and beconiing increasingly unsafe, as the traffic volumnes increase due to further developmnent in this area,"- states a public works department report. To get around the congestion, the Town wants the developer te build a median to prevent left turns into the gas bar from Dundas. Paul Wilson, a spokesman for the developer, told administrative committee last week bis firm does not have any problems with building the median although "owe areý not convinced it is necessary.- But Wilson did have a problemn with the road improvements required by the Town as a result of building the rnedian. According to'the department, work will involve total reconstruction of the intersection, widening of Dundas St. and placing new traffic signais on the median. "These road improvements are our concern. There are no specifics of design or amount of costs," said Wilson. When committee asked 1dm if he would like to have the matter tabled te reconsider, Wilson replied be would prefer te have thesix months te deal with the work.
