The trial of Michael John Huniphries of Oshawa, charged after a Whitby student died when struck by a, vebicle in February 1987, began in provincial court in, Whitby on Monday. Humphiries was charged with unlawful driving, failure tù, stop and assist, and cri minal neg- ligence causing death after Craig Holley died of injuries received when struck by'a vehicle.* On Monday, Humphries pleaded guilt.y to the second charge and pleaded not guilty te unlawful driving and criminal negligence causing death. Police had reported that a bit, and run took place, on Hopkins St., south of the railway tracks, in Whitby on Feb. 1 last year. Holley had been walking home with a friend, Kevin Brown, 17. After Holley was *struck, the vehicle left the scene. The court heard the testiniony of Brown on Monday afternoon. He testified they had been walking home after spending some time at the McDonald's on Thickson Road. Holley was to be home by 8 p.m. so they decided to take a shorter route via Hopkins St., a route they took often. * hey were on the west side of, the street, under street lights', according to Brown, "about a foot in~ from the aspha:It" on the sf shoulder when the driver of vehicle struck Holley from behind.
