ADDITIONAL INFORMATION en EBy-aw No. 2965-91 gpay 1bLN M BY-LAW NO. 2965-91 BRlNG AN INTERIM CoNTROLi RV4LAW WHEREAS, Section 37 of the 2lamina Act, 1983, provides that where the Council of a local municipality has directed that a review or study be undertaken in respect of land use planning in a defined area of thie munlcipality, it may pass a by-law ta be in effect for a period of time specifled in the by-law prohibiting the use of land, buildings, or structures within the defined area, or portion thereof exoept for such purposes as are set out in the by-law; 1 AND WHEREAS, the Council o! the Corporation of the Town of Whitby. has dlrected that a study be carrieci out ta recommend appropfiate zoning to implement the policies of the Downtown Secondary Plan; AND WHEREAS, the zoning of certain properties within the Study Aiea does not conform to the Low Density Residentiat designation and policies of the approved Downtawn Secondary Plan; AND WHEREAS, some considerable lime may elapse before such study and amendlng zoning by-laws may be finalized and passed by Council; AND WHEREAS, the Council of the Corporation of the Town o! Whitby deems it desirable to puss this by-law.pursuant to the provisions of Section 37 of the Planning Act, 1983, ta limit the use of the lands outlined in Schedlule *A-1 annexed hereto for the lime peniod hemeinafter meferred ta; NOW THEREFORE, the Council of the Corporation of the Town o! Whitby enacts as follows: 1. In accordance With the provisions o! Section 370of the Planning Act~ 1983, dme area o! land shown on Schedule OA-1 ta this By-law and marlced *Subject Property% is defined as an lnterim control aiea. 2. Notwithstanding thu provisions of Zoning By-law No. 2585, as amended, no person shall within the lnterim control aiea use any lot or erect, alter or use any building or structure for any purpose except the following use; namely: one single family or semni-detached dwelling house on a lot which was, on January 30, 1991, held under distinct and separate ownership from abutting lands as shown by a registered conveyance in the records of the Registry Office or the Land Tills Office. 3. The zone provisions set forth in Section 7, Subsections (1) and (2) of By-law No. 2585 shall apply ta the development of any uses referred ta in Section 2 of this By-law. In regard ta due construction or alteration o! a single !amily or semi-detached dwelling house, the provisions of Section 7 of sald By-law No. 2585 shall bu read and construed as if such dwelling house were within the 'R-3' Residential zone o! By-law No. 2585. 4. The general provisions of Section 6 of By-law No. 2585 shaîl also apply ta any development in the aiea affected by this By-law. 5. The provisions af this By-law shall corne ia force and takçe effect upon the date of passing and shail romain in effect for a peniod o! one year from due date hereof unless repealed in the interim.
