Peter Bell, 47, was fined $90 000 and his company, Avion Yacht Sales Ltd., $6,720 follow- ing a hearing in Ontario Court (Provincial Division) in Whitby. Bell and the company pleaded guilty to charges of wilfully fail- ing to remit $96,720 in taxes colted on the sale of boats from July 1989 to December 1991. Court was told the former Charles Street business sold'cus- tom-built boats in the $75,000 to $400,000 price range. Ministry of Finance prosecutor John Fagan said the company's sales tax returns were falsified to conceal the amount collected. Bell admitted collecting the tax, but claimed he did not in- tend te keep it for himself. Bell testified that his business was under a great deal of press- ure and that he had not reported all the tax because he simply was not able to pay it. Justice of the Peace Jack Mil- lar said Bell's failure to remit the tax was a breach of trust. He rejected Bell's request for a fine in the range of $50,000 by pointing out that the evasion took place over an extended period of time. Bell was given one year to pay the fine, with the possibility of an extension at the end of that time. Re/Max Realty Plus Inc., on Westney Road South in Ajax until it closed early in 1992, its president Michael Stephen Lindo of Stouffville and employee John William Midlige of Whitby have been jointly charged with cri- minal breach of trust and theft over $1,000.
