20 WINNETKA WEEKLY TALK, SATURDAY, JULY 28, 1923 VILLAGE OF WINNETKA Record of a regular meeting of the Council of the Village of Winnetka, held in the Council Chamber of the Village Hall, in the Village of Win- netka, Cook County, Illinois, at eight o'clock P. M. Tuesday, July 17th, 1923. The meeting was called to order by President Miller. Present: President Miller, Trustees Aldrich, Brown, Frank, Pierce, Langworthy and Tenney. On motion by Trustee Tenney, sec- onded by Trustee Langworthy, and car- ried, all voting aye, the reading of the minutes of the previous meeting was dispensed with. Trustee Langworthy, Chairman of the Committee on Plats and Zoning, reported on the recommendation from the Board of Appeals that the block bounded by North Avenue, Linden Ave- nue, Chatfield Road and Center Street should be rezoned, the east half of the block to be zoned "Commercial" and the west half of the block "B Res- idence." The Committee recommended that the recommendation of the Board of Appeals with regard to the east half of the block be accepted and it was moved by Trustee Langworthy, seconded by Trustee Pierce, to request the Village Attorney to prepare an or- dinance in accordance therewith. On roll call, Trustees Aldrich, Brown, Frank, Pierce, Langworthy and Tenney voted aye. Trustee Frank, Chairman or ine Ju- diciary Committee, to which was re- ferred the plat of the Alles tract reported that it was the recommenda- tion of the Committee that the plat be not approved. It was moved by Trus- tee Frank, seconded by Trustee Pierce, that the recommendation of the Com- mittee be accepted, and that the plat be not approved. On roll call, Trus- tees Aldrich, Brown, Frank, Pierce, Langworthy and Tenney voted aye. Manager Woolhiser presented a drawing of a proposed building which Nelson Brothers plan to erect on the corner of Chestnut and Spruce Streets, which property they now own and which they desire to use for business purposes. After discussion, it was mov- ed by Trustee Frank, seconded by Trustee Tenney, and carried, all voting aye, that the matter be referred to the Committee on Plats and Zoning, and the Committee on Public Buildings, for such action as the Committees may determine. The following ordinance was read, and on motion by Trustee Aldrich, sec- oned by Trustee Tenney, was ordered engrossed and posted. On roll call, Trustees Aldrich, Brown, Frank, Pierce, Langworthy and Tenney voted aye. N ORDINANCE PROVIDING FOR THE REMOVAL OF OBSTRUCTIONS FROM LAND TAKEN FOR HIGHWAY PURPOSES. The Council of the Village of Win- netka do ordain: Section 1. That in all cases where proceedings are now pending or may hereafter be brought by the Village of Winnetka under the Local Improve- ments Act of 1897 as now or here- after amended, for a local improvement which will require that private prop- erty be taken or damaged for the pur- pose of opening, extending or widening 'any street, alley or other public high- way upon the entry of an order by the court in which any such pro- ceeding may be pending granting to the Village of Winnetka the right to take possession of or to dam- age the property therein condemned, and in respect to which compensa- tion shall have been made or deposit- ed as provided by law, the Superin- tendent of Public Works forthwith shall cause to be removed from the land so taken for the purpose of open- ing, extending or widening such high- way, any building or part thereof sit- uated thereon, and to such extent as may be necessary, shall cause to be removed, shifted or altered, any side- walk, curb, pavement, fence or any other thing -of any nature whatsoever on said land or on any public highway 'connecting or intersecting with said land, whenever the same shall consti- tute an obstruction to public travel on ;said land or to and from said land and 'any such intersecting or connecting 'public highway. The said Superinten- 'dent of Public Works shall also cause "the surface of such land and of such 'highway intersection or connections to "pe made passable for public travel and, so far as such work may be necessary for such purpose, he shall cause the surface of said land and the inter- 'sections and connections of the same ZAwith any such highway, to be raised wor lowered, ditches to be excavated or ifilled, culverts to be placed and rail- 'road tracks to be planked. ! rROVIDED, HOWEVER, that if at the time or the entry of an order of "possession as aforesaid, there shall be either pending or confirmed under the said Local Improvements Act of 1897 'As now or hereafter amended, a pro- Feeeding or proceewings scpa.ale 1o0in said condemnation proceeding or com- bined therewith for paving or other- Jwise improving the surface of such and so taken for highway purposes, fthen and in that event, said Superin- "tendent of Public Works shall do or 'cause to be done only so much of the aforesaid work as is not included in .any of said improvement proceedings, and shali do the remainder of the work, "or cause it to be done, only when and in case such improvement proceedings shall not be connrmed or executed. All of the aforesaid work herein provided to be done by the said Superintendent of Public Works shall be paid for out of the general fund of the Village of Winnetka. This section shall be construed as being in aid of, and not in conflict with the provisions of the lL.ocal Improve- ments Act of 1897 as now or hereafter amended. Section 2. AN ORDINANCE FOR THE VACATION OF ALL OF THAT PART OF BERTLING LANE LYING SOUTHERLY AND WEST- ERLY OF LOT 24, TRIER CENTER NEIGHBORHOOD BEING A SUB- DIVISION OF LOT 1 OF CIRCUIT "COURT ~~ PARTITION" IN THE SOUTHEAST QUARTER OF SEC- TION 21, TOWNSHIP 42 NORTH, RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN, AND EAST OF THE WEST LINE EXTENDED OF LOT 23 OF SAID TRIER CEN- TER NEIGHBORHOOD AND NORTH OF THE NORTH LINE EXTENDED OF WINNETKA AVE- NUE, IN THE VILLAGE OF WIN- NETKA, COOK COUNTY, ILLINOIS. The Council of the Village of Win- netka do ordain: SECTION 1. That all of that part of Bertling Lane lying southerly and westerly of Lot 24, Trier Center Neigh- borhood, being a subdivision of Lot 7 of Circuit Court Partition in the South- east Quarter of Section 21, Township 42 North, Range 13 East of the Third Principal Meridian, and east of the west line extended of Lot 24 of said Trier Center Neighborhood and north of the north line extended of Winnetka Avenue, in the Village of Winnetka, Cook County, Illinois, in no way fur- nishes access to any lot or property in said Trier Center Neighborhood other than Lot 24 in said Trier Center neighborhood, or to any persons other than the occupants or owners of said Lot 24 and is not used by the general public and that said portion of said Bertling Lane hereinabove described is no longer required by the public as a public highway or street, and that the interests of the public will be sub- served by the vacation of the portion of said Bertling Lane hereinabove = des- cribed. SECTION 2. That all of that part of Bertling Lane lying southerly and westerly of Lot 24 Trier Center Neigh- borhood, being a subdivision of Lot 7, Circuit Court Partition in the South- east Quarter of Section 21, Township 42 North, Range 13 East of the Third Principal Meridian, and east of the west line extended of Lot 24 of said Trier Center Neighborhood and north of the north line extended of Winnetka Avenue, in the Village of Winnetka, Cook County, Illinois, be and the same is hereby vacated and closed; PRO- VIDED, HOWEVER, that within thirty (30) days after the passage of this or- dinance WILLIAM SUMMER SMITH shall pay to the Village of Winnetka the sum of Fifty Dollars ($50.00) to- ward a fund for the payment and sat- isfaction of any and all claims for damages which may arise from the vacation of said portion of the said Bertling Lane as hereinabove provided for; and PROVIDED, FURTHER that if said sum of money is not suf- ficient to pay all damages occa- sioned by the taking effect of this ordinance, the said WILLIAM SUMMER SMITH, his administra- tors, executors, or assigns shall not be liable to pay to said Village of Win- netka any further sum on account of such vacation, and if the damages oc- casioned by the taking effect of this crdinance do not amount to the sum above provided to be paid, or if no damage whatsoever shall arise by the taking effect of this ordinance, or if no action, proceeding, suit or claim against the said Village of Winnetka shall be instituted or filed within the periods of time limited by law because of the vacation of said portion of said Bertling Lane, the Village of Win- netka shall not be liable to repay to the person or persons hereinabove mentioned or any of them the said sum of Fifty Dollars ($50.00) or any portion of said Fifty Dollars ($50.00) or any sum whatsoever; and PROVID- ED, FURTHER that the said WIL- LIAM SUMMER SMITH will, within thirty (30) days after the passage of this ordinance remove or enter into a contract for the removal of the side- walk now located on the portion of said Bertling Lane hereinabove des- cribed and also construct, or enter into a contract for the construction of a Portland cement concrete sidewalk five feet four inches in width and in all respects in conformity to the ordin- ances of the Village of Winnetka, along the lines and grades to be furnished by the Engineer for the Village of Winnetka and in such manner as to correspond with a similar sidewalk on the opposite side of said Bertling Lane. SECTION 3. This ordinance shall be in force and effect from and after its passage, approval and posting; SUBJECT, HOWEVER, to the -condi- tions in Section 1 hereof, and provided that the said WILLIAM SUMMER SMITH shall; within thirty (30) days after the passage of this ordinance, file for record in the office of the Re- corder of Cook County, Illinois, a cer- tified copy of this ordinance. LuSLees AN ORDINANCE TURNING OVER TO WINNETKA PARK DISTRICT A CERTAIN POR- "TION OF' ' BERTLING LANE WHERE THE SAME INTERSECTS WITH WINNETKA AVENUE, IN THE VILLAGE OF WINNETKA. WHEREAS the Village of Winnetka has title to a certain portion of Bert- ling Lane hereinafter particularly des- cribed and situated at the intersection of said Bertling I.ane and Winnetka Avenue, and holds the same for use as a public park and said portion of «aid Bertling Lane is located within the limits of the Winnetka Park Dis- wrict, a municipal corporation organ- ized and existing under an act of. the General Assembly of the State of 11li- nois approved June 24, 1895, entitled "An Act to provide for the Organiza- tion of Park Districts and the Transfer of Submerged Lands to Those border- ing on Navigable Bodies of Water," and it is desired that said area be turned over to said Winnetka Park District; and WHEREAS by the terms of said act of June 24, 1895, it is provided that any park in any municipality within the mits of any park district created un- der said act may, with the consent of such municipality, be turned over to and placed under the control, of the commissioners of said district, and there is reserved to all municipalities lying within the limits of any park district created under said act the right to lay and repair water and sew- er pipe under the surface of any such park therein, in the same manner and to the same extent that it could have been done before the organization of such park district; now therefore, THE COUNCIL OF THE VILLAGE OF WINNETKA DO ORDAIN: SECTION 1. That there is hereby turned over to and placed under the control and maintenance of the Park Commissioners of Winnetka Park Dis- trict the following described area with- in the Village of Winnetka, to-wit: That part of BERTLING LANE lying easterly and southerly of Lot Trier Center Neighborhood, being a subdivision of Lot 7 of Circuit . Court Partition in the Southeast Quarter of Section 21, Township 42 North, Range 13 East of the Third Principal Meridian, and west of the east line extended of Lot 29 of said Trier Center Neighborhood and north of the north line extended of Winnetka Avenue, in the Vil- lage of Winnetka, Cook County, Illinois. SECTION 2. That the Village of Winnetka does hereby give its consent that said park and area be turned over to and placed under the control and maintenance of said Park Com- missioners for public park purposes in accordance with the provisions of said Act of June 24, 1895, but subject to any conditions, restrictions or lim- itations under which the Village of Winnetka may hold the same. SECTION 3. That the said area shall not be sold, granted, conveyed or en- cumbered without the consent of the Village of Winnetka, evidenced by a resolution of the Village Council of said Village, nor shall any permanent building or structure be erected there- on without such consent evidenced by like resolution. SECTION 4. That this ordinance shall be in force and effect from and after its passage, approval and posting. President of the Village of Winnetka. An Ordinance providing for the ap- pointment of a Board of Appeals under ithe provisions of an Act of the Gen- eral Assembly of the State of Illinois entitled, "An Act to confer certain ad- ditional powers upon City Councils in cities and presidents and boards of Trustees in Villages and incorporated towns concerning buildings and struc- tures, the intensity of use of lot areas, the classification of trades, industries, buildings, and structures, with res- pect to location and regulation, the creation of districts of different classes, the establishment of regulations and restrictions applicable thereto, the es- tablishment of boards of appeals and the review of the decisions of such boards by the court," read, ordered engro d and posted at the meeting of the Council of the Village of Win- netka held on July 3rd, 1923, was again read. On motion by Trustee Pierce, sec- onded by Trustee Langworthy, the fol- lowing resolution was adopted: BE IT RESOLVED by the President and Board of Trustees of the Village of Winnetka in Council assembled that Section 1 of an Ordinance providing for the appointment of a Board of Appeals, introduced and ordered en- grossed and posted at the meeting of the Council of the Village of Winnetka held on the third day of July, 1923, be amended by adding after the last word of said Section the following: "and any vacancy shall be filled in like manner." On roll call, Trustees Aldrich, Brown, Frank, Pierce, Langworthy and Tenney voted aye. On mouion by Trustee Brown, sec- oned by Trustee Pierce, the above or- dinance was passed as amended. On roll call, Trustees Aldrich, Brown, Frank, Pierce, Langworthy and Ten- ney voted aye. An ordinance amending Chapter XXIV of the Municipal Code of the Vil- lage of Winnetka entitled "Health" by adding thereto two sections to be designated Sections 279-a and 279-b read, ordered engrossed and posted at the meeting of the Council of the Vil- lage of Winnetka held on July 3rd, 1923, was again read. On motion by Trustee Frank, sec- oned by Trustee Langworthy, the fol- lowing resolution was adopted: BE IT RESOVLED by the President and Board otf Trustees of the Village of Winnetka in Council assembled, that Section 1 of an ordinance amend- ing Chapter XXIV of the Municipal Code of the Village of Winnetka en- titled "Health" be and the same is hereby amended by striking from Sec- tion 279-a the words "And any lands subject to overflow by water at any time of the calendar year." BE IT FURTHER RESOLVED that Section 1 of said ordinance be amended by adding to Section 279-b after the word "Clerk" in the eighth line of said section, the words "unless, upon application by the owner of such land to the Village Council, the Village Council shall, by resolution, determine that the finding of the Village Health Officer is incorrect, or".
