Chicago Amends Message "The City of Chicago is preceeding ZONING CHANGE with amendments to its zoning ordi- Regional Planning Associa- tion Advises Temporary Halt in Amendments AWAIT EVANSTON CASE Expect Decision of Supreme Court in April North shore villages were this week advised by the Chicago Regional Plan- ning association not to take final ac- tion in amending their zoning ordi- nances until after the April term of the Illinois Supreme court, at which time the now celebrated Aurora zoning case will be presented for re-hearing. "As a matter of service to the com- munities in the region of Chicago the committee on legislation of the Chicago Regional Planning association has given study to the effect of the recent decision of the Illinois Supreme court in the Aurora zoning case," reads the association's notice. "It seems that several of the cities and villages in Illinois are at work on amendments to their ordinances to make them conform to the decision. Divergence of Opinion "There is a divergence of opinion in regard to the exact meaning of cer- tain parts of the decision. "A petition for re-hearing of the case is being presented to the Illinois Supreme court and will probably be acted upon at the April term. The court has before it another zoning case, this one from Evanston and a decision in this case is expected at the April term. "In view of the petition for re-hear- ing in the Aurora case and the pending Evanston case it is suggested that no final action be taken by city and vii- lage councils in amending existing zoning ordinances. "The committee feels that most of the cities and villages of the region do not immediately need to go to the ex- tent that the City of Chicago has done, and that the weight of advantage is in favor of delay until the decision of the State Supreme court in pending pro- ceedings." In the much-discussed Aurora case the State Supreme court held that where, in a section of one classifica- tion, there was established a structure of another classification, other struc- tures of the non-conforming classifica- tion could not be prohibited. For example, if there is established one commercial structure in a section zoned residential, other commercial structures cannot be barred from that section. May Nullify Law The action of the court is thought by many zoning experts to virtually nullify all zoning ordinances. Others, however, feel that the decision is not significant.
