Allen, and "All Whom It May Concern." The Superior Court of Cook County, Illinois, by order duly entered in the above entitled proceedings, having 1i- rected that as to such of said defend- ants as are shown by the affidavit filed in said proceedings, to be non- residents of the State of Illinois, or whose residences are shown thereby to be unknown, and the defendants designated as "All whom it may con- cern," the Clerk of said Court cause publication to be made in the Win- netka Weekly Talk, a secular news- paper published in the Village of Winnetka, County of Cook and State of Illinois, containing notice of the fol- lowing matters: Notice is hereby given of the pend- ency of the above entitled proceed- ings instituted by the petition of the Village of Winnetka, heretofore filed in the Superior Court of Cook County, Illinois, designated General Number 423317 in said Court, praying for the ascertainment of the just com- pensation to be made for the private property to be taken or damaged for the making of the improvement here- inafter described, and for the ascer- tainment of what property will be benefited by the making of said im- provement, and the amount of such benefit. _ The Commissioners duly appointed by the said Superior Court of Cook County, Illinois, to investigate and re- port the just compensation to be made for the private property to be taken or damaged for said improvement, and, also, what real estate will be bene- fited by said improvement, and the amount of such benefit to each parcel of land assessed, duly made a special assessment to raise the cost of such jmprovenent, and filed their report and assessment roll in the office of the Clerk of said Court on the fifteenth day of October, A. D. 1925. Thereupon a summons issued out of said Court against the defendants above named, and the defendants de- scribed as "All whom it may concern." returnable in said Court at the County Court House in the City of Chicago, County of Cook and State of Illinois, on the seventeenth day of November, A. D. 1925, as is by law required, which proceeding is now pending. The total cost of said improvement. as shown by the estimate of the Presi- dent of the Board of Local Improve- ments of the said Village of Winnetka and the report and assessment roll of said Commissioners, is the sum of Three Hundred Four Thousand. One Hundred Forty-six Dollars and eighty-two cents (304,146.82). D. 1925, and plead, an- swer or demur to the petitioner's peti- tion, or object to the report and as- sessment roll of the Commissioners aforesaid, the same and the matters and things therein charged and stated will be taken as confessed, and a judgment entered in accordance with the said report and assessment roll and the prayer of said petition. e following is a description of the said improvement, and includes a description of She lots, sr oKs, tracts els of land sought to be take for the said improvement: » That a new street be opened, and that Church Road (formerly Church Street and Maple Avenue) be widened by condemning therefor the following described tracts of land, including all buildings and other structures located thereon: TRACT NUMBER 1. That part ot Lot Twelve (12) in Whitman's Sub- division of all that part of the South Quarter of the Southwest Quarter of Fractional Section Twenty-one (21) in Township Forty-two (42) North, Range Thirteen (13) East of Lhe Third Principal Meridian which lies east of the center line of Church Road and west of the right-of-way of the Chicago and North Western Railway Company, that is described as follows: Beginning at the South- east corner of said Lot Twelve (12); thence west along the south line of said Lot Twelve (12) twenty-eight (28) feet; thence northeasterly in a straight line, twenty-seven and two- tenths (27.2) feet, to a point in the northeasterly line of said Lot Twelve (12), twenty-nine (29) feet north- westerly from the southeast corner of said Lot Twelve (12); thence southeasterly along the northeasterly line of said Lot Twelve (12), twenty- nine (29) feet, to the point of begin- ning, all in the Village of Winnetka, County of Cook and State of Illinois. TRACT NUMBER 2. That part of the South Quarter of the Southwest Quarter of Fractional Section Twen- ty-one (21) in Township Forty-two (42) North, Range Thirteen (13) East of the Third Principal Meridian, bounded on the northeasterly side by the southwesterly line of the present right-of-way of the Chicago and North Western Railway Company, and on the southwesterly side by a line drawn parallel with and two hundred (200) feet southwesterly, measured at right angles, from the said southwesterly line of right-of way, and extending across said South Quarter of said Southwest Quarter, and being the same land conveyed by Roland D. Whitman and wife to the Chicago and North West- ern Railway Company, by deed dated November 21, A. D. 1913, and record- ed in the office of the Recorder of Cook County, Illinois, in Book 12788, at page 175, as Document Number 5341006, that is described as follows: A tract of land eighty (80) feet in width, lying southwesterly of and ad- joining a line drawn parallel with and eighty (80) feet northeasterly from, as measured at right angles to, the southwesterly line of the said hereinabove described tract of land, excepting therefrom that part of said tract of land eighty (80) feet in width lying south of a line thirty (30) feet north of and parallel with the south line and said south line extended of said tract of land eighty (80) feet in width, used and occupied as a public street known as Winnet- ka Avenue, the said tract of land eighty (80) feet in width being the southwesterly eighty (80) feet of the said tract of land two hundred (200) feet in width hereinabove described, excepting therefrom that part of said tract of land eighty (80) feet in width lying south of a line thirty (30) feet north of and parallel with the south line and said south line ex- tended of said tract of land eighty (80) feet in width, used and occu- pied as a public street known as Winnetka Avenue, all in the Village of Winnetka, County of Cook and State of Illinois. TRACT NUMBER 3. That part of the south three (3) acres of Block Twenty-six (26) in John C. Garland's Addition to Winnetka, being a Sub- division of the North 'one hundred twenty (120) acres of the Southwest Quarter of Fractional Section Twen- ty-one (21) in Township Forty-two (42) North, Range Thirteen (13) East of the Third Principal Meridian, said south three (3) acres being also described as follows: Beginning at a point on the Chicago and North Western Railroad and Tanning from thence West along the north line of Fortman's land, being also the north line of the south quarter of the southwest quarter of said Fractional Section Twenty-one (21) six hundred nineteen (619) feet and one (1) inch: from thence north along the old Church Road leading to Winnetka, two hundred thirty-two (232) feet and six (6) inches; from thence east five hundred twenty (520) feet: thence south along the line of rail- road, two hundred seventy (270) feet and nine (9) inches to the point of beginning, containing three (3) acres, that is described as follows: Beginning at a point in the south line of said Block Twenty-six (26) two hundred thirty-seven and nine- tenths (237.9) feet west of the south- east corner of said Block Twenty- six (26), being also the northeast corner of Lot Twelve (12) in Whit- man's Subdivision of all that part of the South Quarter of the South- west Quarter of Fractional Section Twenty-one (21) in Township For- tyv-two (42) North, Range Thirteen (13) East of the Third Principal Me- ridian, which lies east of the center line of Church Road and west of the right-of-way of the Chicago and North Western Railway Company, and running thence northwesterly in a straight line two hundred forty- one and eighty-one . hundredths (241.81) feet, to a point in the north line of said three (3) acre tract, one hundred seventy-three and thirty hundredths (173.30) feet west of the intersection of said north line with the southwesterly line of the right- of-way of the Chicago and North Western Railway Company; thence east along the north line of said three (3) acre tract, ninety-five and eighteen hundredths (95.18) feet to a point seventy-ecight and twelve hundredths (78.12) feet west of the intersection of said north line with the southwesterly line of the right- of-way of the Chicago and North Western Railway Company; thence southeasterly in a straight line two hundred forty-one and eighty-six hundredths (241,86) feet to a point in the south line of said Block Twenty-six (26), one hundred forty- two and seven tenths (142.7) feet west of the southeast corner of said block as measured along the south line thereof; thence west along the south line of said Block Twenty-six (26), ninety-five and two tenths (95.2) feet to the point of beginning, all in the Village of Winnetka, County of Cook, and State of Illi- nois. TRACT NUMBER 4. That part of a tract of land in Block Twenty-six (26) in John C. Garland's Addition to Winnetka, being a Subdivision of the North one hundred twenty (120) acres of the Southwest Quarter of Fractional Section Twenty-one (21), in Township Forty-two (42) North, Range Thirteen (13) East of the Third Principal Meridian, described as" beginning on the southwesterly line of the right-of-way of the Chi- cago and North Western Railway Company, at a point two hundred seventy and seventy-five hundredths (270.75) feet north from the soutk line of said Block Twenty-six (26) aforesaid, as measured along the west line of said right-of-way, and being the northeast corner of George W. Deily's land; thence west along the north line of the South Three (3) acres of said Block Twenty-six (26), five hundred twenty (520) feet to the easterly line of the old Church Road leading to Winnetka; thence northwesterly along the easterly line of said old Church road, eighty-three and seventy-five hundredths (83.75) feet; thence east along the north line of lands now owned by John Kie- wik to the southwesterly 'line of said right-of-way, and thence south- easterly along the said southwes®- erly line of said right-of-way to the point of beginning, that is de- scribed as follows: Beginning at a point in the south line of said hera2- inabove described tract, being also the north line of the south three (3) acres of said Block Twenty-six (26), one hundred seventy-three and thir- ty hundredths (173.30) feet west, as measured along said south line, from its intersection with the southwest- erly line of the right-of-way of the Chicago and North Western Railway Company; thence northwesterly in a straight line eighty-seven and eigh- teen hundredths (87.18) feet to a point in the north line of said here- inabove described tract one hundred fifty and six hundredths (150.06) feet west, as measured along said north line, from its intersection with the southwesterly line of the right-of- way of the Chicago and North West- ern Railway Company; thence east along said north line, ninety-five and eighteen hundreths (95.18) feet, to a point in said north line fifty-four and eighty-eight hundreths (54.88) feet west, as measured along said north line, from its intersection with the southwesterly line of the right- of-way of the Chicago and North Western Railway Company; thence southeasterly in a straight line eigh- ty-seven and eighteen hundredths (87.18) feet to a point in the south line of the hereinabove described tract, seventy-eight and twelve hun- dreths (78.12) feet west, as meas- ured along said south line, from its intersection with the southwesterly line of the right-of-way of the Chi- cago and North Western Railway Co.; thence west along said south line ninety-five and eighteen hun- dredths (95.18) feet, to the point of beginning, all in the Village of Win- netka, County of Cook and State of Illinois. TRACT NUMBER 5. That part of the north one hundred ninety-seven and five tenths (197.5) feet west of railroad of Block Twenty-six (26) in John C. Garland's Addition to Win- netka, being a Subdivision of the North one hundred twenty (120) acres of the Southwest Quarter of Fractional Section Twenty-one (21) in Township Forty-two (42) North, Range Thirteen (13) Bast of the Third Principal Meridian, and more particularly described as follows: Commencing at the northwest corner of said Block Twenty-six (26) and running thence south one hundred ninety-seven and five-tenths (197.5) feet, to Elias Brown's (now John Kiewik's) northwest corner; thence east along said line (being the north line of lands now owned by John Kiewik) to the Chicago and Milwau- kee Railroad (now the Chicago and North Western Railway); thence (north) along that line (the south- westerly line of the right-of-way of the Chicago and North Western Rail- way Company) to the northeast cor- ner of said Block Twenty-six (26); thence west (along the north line of said block) to the place of beginning, containing two (2) acres, more or less, that is described as follows: Be- ginning at a point in the south line of said hereinabove described tract one hundred fifty and six hundredths (150.06) feet west, as measured along said south line, from its intersection with the southwesterly line of the right-of-way of the Chicago and North Western Railway Company; thence northwesterly in a straight line two hundred five and eighty-five hundredths (205.85) feet to a point in the north line of said Block twen- ty-six (26), ninety-five and eighteen hundredths (95.18) feet west, as measured along said north line, from the northeast corner of said Block Twenty-six (26); thence east along the north line of said Block Twenty- six (26), ninety-five and eighteen hundredths (95.18) feet, to the north- east corner of said Block Twenty-six (26); thence southeasterly in a straight line two hundred five and eighty-five hundredths (205.85) feet to a point in the south line of said hereinabove described tract, fifty- four and eighty-eight hundredths (54.88) feet west of, as measured along the said south line, from its intersection with the southwesterly line of the right-of-way of the Chi- cago and North Western Railway Company; thence west along the said south line of said tract, ninety-five and eighteen hundredths (95.18) feet, to the point of beginning, all in the Village of Winnetka, County of Cook and State of Illinois. Garland's Addition to Winnetka, be- ing a Subdivision of the North one hundred twenty (120) acres of the Southwest Quarter of Fractional Sec- tion Twenty-one (21), in Township Forty-two (42) North, Range Thir- teen (13) East of the Third (3rd) Principal Meridian, beginning at the southeast corner of said Block Twen- ty-five (25); thence west along the south line of Block Twenty-five (25) ninety-five and eighteen hundredths (95.18) feet to a point in said line eighty (80) feet southwesterly from, as measured at right angles to, the southwesterly line of the right-of-way of the Chicago and North Western Railway Company; thence northwesterly along a straight line a distance of two hundred thir- ty-two (232) feet, to a point in a line drawn parallel with and sixty-six (66) feet southwesterly from, as measured at right angles to, the southwesterly line of the right-of- way of the Chicago and North West- ern Railway Company; thence nortH- westerly along said parallel line one hundred eighty-five and five hun- dredths (185.05) feet to its intersec- tion with the center line of Elder Lane (formerly Central Avenue) ex- tended from the west in a straight line; thence east along said center line extended of Elder Lane (for- merly Central Avenue) seventy-eight and forty-seven hundredths (78.47) feet to its intersection with the southwesterly line of the right-of- way of the Chicago and North West- ern Railway Company; thence south- easterly along said southwesterly line of the right-of-way of the Chi- cago and North Western Railway Company four hundred twenty-five and nine tenths (425.9) feet to the point of beginning, all in the Village of Winnetka, County of Cook and State of Illinois. TRACT NUMBER 17. That part of Block Twenty-five (25) in John C. Garland's Addition to Winneka, be- ing a Subdivision of the North one hundred twenty (120) acres of the Southwest Quarter of Fractional Section Twenty-one (21), in Township Forty-two (42) North, Range Thir- teen (13) East of the Third Princi- pal Meridian, lying northeasterly of and adjoining a line drawn parallel with and sixty-six (66) feet south- westerly from as measured at right angles to, the southwesterly line of the right-of-way of the Chicago and North Western Railway Company and north of the center line extend- ed -from the west in a straight line, of Elder Lane (formerly Central Ave- nue), excepting therefrom that part of said tract of land lying westerly of the easterly. line of Church Road (formerly Church Street and Maple Avenue), all in the Village of Win- netka, County of Cook and State of Illinois.
