Real Estatë with Betty Smith Easements and Rights-of-Way An Easement may be defined as "the right of one land owner to the partial use of the land of an adjoining owner". The privilege to use another person's property property is obtained for a special special purpose or necessary benefit (such as an entrance way) and not just for the general use or occupation of the land. The most common type of easement is the Right- of-Way. This right of use "runs with the land", meaning it passes from owner to owner at the time of a sale or deed transfer and it binds all subsequent owners. Easements give a mere right to pass and repass over a neighbour's property property but never to obstruct the area. It is therefore not acceptable to park a vehicle vehicle in or otherwise block a right-of-way. As Realtors, we know that it's vitally important that easements be accurately accurately identified and described. Proper registerable legal description must be used by us on ALL documents pertaining to your Real Estate transactions, such as Listing Agreements and Offers to Purchase.
