Apartments in Houses It is estimated that more than 100,000 illegal apartments apartments exist in homes across Ontario. The Residents' Right Act (Bill 120) now makes it legal for Ontario homeowners to have one self-contained apartment in their single family residence (detached, semi-detached or row house) provided that the unit meets Building and Fire Codes and reasonable Planning Standards. In order to obtain legal status for these apartments, homeowners are now obligated obligated to ensure that these units are safe. Fire Code standards cover such areas as smoke alarms, fire separation walls, fire exits and electrical safety. Building Codes address things such as ceiling heights, room and window sizes and ventilation. The deadline for meeting these requirements is July 14,1996. CMHC financing is available available on homes which have accessory apartments. However, if the rental income is required to qualify the Purchaser, the apartment must be in compliance with current legislation (Bill 120). Safe, legal apartments in homes will benefit both Purchasers and Vendors alike. They will, in many cases, increase the value of the property, make it easier to obtain mortgage financing and insurance as well as improve the resale value of the home. For more information on the above, contact your local Planning and Fire Departments and Ontario Hydro.
