So, given that they're such an important issue, what's wrong with the concept of having having a Moving Bill of Rights? You know, a formal declaration declaration of the rights and responsibilities responsibilities of each party associated with a household or business move. I tossed the question to Mike LeSage, the marketing and sales VP of Allied Van Lines, one of the country's biggest and best-known moving moving organizations, and he's in favour of such a declaration, so long as it's written in clear, simple, straightforward lan guage. He calls it a "printed handshake" kind of document that leaves no room for questions. questions. "Just about eveiything you'd want in a Moving Bill of Rights is probably- already located located somewhere in the written material that movers and their customers jointly sign," he says, "but you might have a bit of a time winnowing it out. The law of agency, is the most important branch of the law with which Real Estate practitioners practitioners come in contact. When someone acts on behalf of another party, he or she is legally considered to be an extension of that party. As that party's AGENT, he or she is obliged to look after the best interest of that person (known as the "client" or "principal") and to obey all lawful instructions instructions of the client. It is mandatory for Realtors to fully disclose, in writing, to all parties of a transaction, the exact nature of the agency relationship relationship that exists and the nature of the service that the member will be providing. So, prior to buying or selling, meet with your Realtor and have him or her explain to you the intricacies intricacies of Agency and Agency Disclosure. Their people are trained from Day One to never forget that they're not just moving household goods, office office equipment, or other intangibles; intangibles; they're moving people, families and companies,. I asked LeSage what he believes believes belongs in a formally declared declared Moving Bill of Rights. His response was clear and to the point. "Simple truths, simply simply told, that leave no room for doubt." And what are his simple truths? What rights do people who are being moved have that shouldn't be abrogated? "If you're being moved by a professional organization," he says, "you have the right to open, honest communication; there should be neither secrets nor surprises that are in any way avoidable. "You have a right to be moved with care and consideration consideration for your needs .and wellbeing; wellbeing; promises made should be kept. "You have a right to a fair and equitable price for the services services that are delivered; needs should never be the fiscal foundation foundation of a move, only service and performance. "You have a right to question question anything troublesome, and the right to prompt, efficient, cooperative and cordial recourse recourse when differences arise; the solution to any problem must always be equitable and reflect facts, not feelings." LeSage sees any moving experience as much a moral contract as a legal one. "The bottom line," he says, "is trust. If you don't truly believe believe that the choice you've made in a mover is comforting enough to walk away from your goods or belongings, and leave them in the total care of those you've hired, then you probably should re-think your situation before you sign on the dotted line. "Personally", he adds, "I've moved several times, with and without an Allied agent, and I've never signed a contract until every little itch has been scratched. I've never once been disappointed, not even when problems arose, because they were always resolved to my satisfaction. In my view, that's the kind of feeling you should have when you're getting ready to make a move, and it's the kind of feeling we try to engender in everyone we deal with." Though Allied hasn't yet formalized its Moving Bill of Rights, LeSage reports the event is under serious consideration, consideration, and might even be announced announced in the late fall. The time, he says, is necessary to assure that everyone associated with the company, from back office staff to sales people and those who schedule and make the move, buys into the belief that goes behind the words. "The people are the binder in any credo of this nature," he • says, "and when our people agree on how we're going to treat and serve all those people we have and want as clients and customers, then we'll have a Moving Bill of Rights that will stand the test of time."
