NOTICE OF PUBLIC MEETING DEVELOPMENT CHARGE PROPOSAL The Municipality of Clarington is considering an amendment to the Development Charge By-law No. 92- 105 pursuant to the Development Charges Act. Council will be holding a public meeting, in accordance with Section 4 of the Development Charges Act, to enable the public to understand generally the amendment to the Development Charge By-law. All members of the public are invited to attend the meeting which will be held on: Monday, September 30,1996 7:00 p.m. Council Chambers Municipal Administrative Centre 40 Temperance Street Bowmanville, Ontario Members of the Public will be given an opportunity at the meeting to make representations regarding the proposed amendment to the Development Charge By-law No. 92- 105, as amended. In addition, written submissions may be forwarded to the Clerk, 40 Temperance Street, Bowmanville, Ontario L1C 3A6 no later than September 25th, 1996. Written submissions received by the Clerk will be available for public viewing during business hours at the Clerk's Department at the above address. Submissions received in writing and those expressed at the Public Meeting will be considered in the preparation of the final report and amendment to the Development Charge By-law. The proposed amendment will permit the owner to pay the Municipality-wide development charge in money or by the provision of a service designated in By-law 92-105, as amended, or by a combination of both as may be agreed upon by the Municipality and the owner in an agreement made under subsection 9(9) of the Development Charges Act. Such an agreement would permit the owner to provjde a designated service in lieu of the payment of all or any portion of a development charge and to be credited with an amount equal to the reasonable cost to the owner of providing the service in question. The proposed amendment will also add to the designated services set out in Schedule "B" of By-law No. 92-105, as amended, the development of a neighbourhood park and a parkette to be located on Blocks 305 and 306, respectively, on draft plan of subdivision 18T-95023 and the development of a parkette to be located on Block 318 on the draft plan of subdivision 18T-89037. The neighbourhood park and parkettes in question were not referenced in the Town of Newcastle Development Charges Policy Report prepared for the Municipality by C.N. Watson & Associates Ltd. and dated March 2, 1992 on which the development charge imposed by By-law No. 92-105 was calculated. Drafts plans of subdivision 18T-89037 and 18T-95023 apply in respect of lands located generally south of Regional Road No. 22 between Townline Road and Prestonvale Road in the south-west Courtice area of the Municipality. The proposed amendment will not increase the amount of the development charge payable on the development of lands in the Municipality of Clarington under By-law No. 92-105, as amended and the Development Charges Act. Its purpose is to permit the owner of lands within the relevant plans of subdivision, conditional on the owner developing at the owner's expense the neighbourhood park and parkette, or the parkette, as the case may be, to obtain a credit against the development charge otherwise payable by the owner of an amount equal to the reasonable cost of the service on the development of the owner's land.
