Bowmanvillc, Saturday, May 10, 1997 Page 9 DEVELOPMENT CHARGES ACT NOTICE OF THE PASSING OF A DEVELOPMENT CHARGES BY-LAW BY THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON TAKE NOTICE that the Council of the Municipality of Clarington passed By-law No. 97-85 on the 28th day of April, 1997, under section 4 of the Development Charges Act. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the by-law by filing v/ith the Clerk of the Municipality of Clarington not later than the 30th day of May, 1997, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection. An explanation of the development charges imposed under By-law No. 97-85 is set out below. Maps showing the lands to which relevant provisions of By-law No. 97-85 apply, and a key map are attached. The complete By-law No. 97-85 is available for inspection in my office during regular business hours. The development charges imposed by the Municipality of Clarington Development Charges By-law, By-law No. 92-105, as amended, are neither increased nor reduced by By-law No. 97-85. The purpose of By-law No. 97-85 is to add certain Schedules to By-law No. 92-105. These Schedules add certain new services to the sen/ices designated by By-law No. 92-105. As well, new Schedules containing maps are added to By-law No. 92r105 to show the Benefiting Areas and the owners of lands which will benefit from the provision of the additional designated services. The costs of the construction and installation of designated services are being front-ended by particular owners of land also located within the relevant benefiting area. The passing of By-law No. 97-85 is necessary to permit the Municipality of Clarington to enter into front-ending agreements under Part II of the Development Charges Act with the owners who are front-ending the costs of the additional designated services so that appropriate portions of the costs will be paid by other owners of the lands within the relevant Benefiting Area who develop their lands within the term of the applicable front ending agreement. New Designated Services Bradshaw Services: 1. Bradshaw Street Road Reconstruction Works including storm sewers, storm connections, road granular, curbs, pavement, sidewalks and other related works along Bradshaw Street from Concession Street northerly approximately 460 metres. Map No. 1 Carruthers & Smith Services: 2. Jackman Tributary Water Quality Pond and Tributary Erosion Protection Works located southwest of the intersection of Middle Road and Scugog Street. Map No. 2. 3. Middle Road Trunk Storm Sewer located from approximately 150 metres north of the intersection of Scugog Street and Middle Road, northerly approximately 570 metres. Map No. 3 4. Middle Road Trunk Storm Sewer located from approximately 150 metres north of the intersection of Scugog Street and Middle Road, southerly approximately 135 metres. Map No. 4 5. Scugog Street Trunk Storm Sewer located from approximately 330 metres north of the intersection of Scugog Street and Middle Road, south easterly approximately 415 metres. Map No. 5 Halloway Services: 6. Longworth Avenue Trunk Storm Sewer and Bowmanville Creek Works from MH1 located at the intersection of Scugog Street and Middle Road, westerly approximately 280 metres to the outfall, and including the Bowmanville Creek-Works located immediately west of the headwall. Map No. 6 7. Trunk Storm Sewer from the intersection of Willey Drive and Laurelwood Street northwesterly along Willey Drive approximately 345 metres, then easterly along Goodwin Avenue approximately 65 metres. Map No. 7 8. Trunk Storm Sewer from the intersection of Willey Drive and Laurelwood Street, northerly approximately 280 metres, then easterly along Honeyman Drive approximately 270 metres, then northerly approximately 155 metres to Gimblett Street, then northerly along Gimblett Street approximately 95 metres. Map No. 8 9. Trunk Storm Sewer from the intersection of Willey Drive and Laurelwood Street southerly along Laurelwood Street approximately 85 metres. Map No. 9 10. The Horban Stormwater Management Facility and all associated Works, located northeast of the intersection of Trulls Road and Nash Road, and including external storm sewers located from approximately 110 metres north of Nash Road, easterly approximately 55 metres from the northeast corner of Nash Road and Trulls Road, northerly approximately 80 metres, then northeasterly approximately 45 metres to the headwall.
