Real W Estate with Betty Smith Surveys and Real Estate Transactions In a Real Estate transaction who is responsible for providing a survey if one can't be found? When you're selling a property, you'll probably be requested by your purchasers to provide them with a house location survey to show them what they're buying. A survey is also necessary for buyers to arrange mortgage financing and lor registering the transaction at the Land Registry Office. A plan of survey, made by a LICENSED LAND SURVEYOR, legally defines and describes exactly what you're actually buying or selling. These plans show the boundaries of the property and location of all improvements (buildings, garages, etc.) They also outline Easements. Richts- ol'-Wav and Encroachments, all of which entitle other people 'to partial use of your property. .. On a standard Agreement of Purchase and Sale form, the Vendor is obligated only to provide documents in his possession, If the vendor cannot locate a suitable survey and is unwilling to pay for a new one, the responsibility usually lies with the Purchaser to do so, if one is required. Sometimes a compromise can he worked out between the putties (possible to share the cost or "build it into the selling price"). Before ordering a new survey, however, there are a number of locations that should be cheeked in order to find an existing one eg: the Vendor's solicitor's office, the Vendor's current mortgagee, the Land Registry Office, neighbours on either side of the property. Typically, your home and land represent your greatest assets, So whether you're Buying or Selling, the cost of a survey, when compared to the total financial Real Estate transaction, is more than a reasonable price to pay for peace of mil'll anil smooth closings!! Key information, to help homeowners homeowners and renters anticipate and deal with potential effects of year 2000 (Y2K) problems, is available from Canada Mortgage and Housing Corporation (CMHC). Aimed at homeowners and occupants of single family family and high-rise buildings, the two new CMHC publications, publications, "Preparing Your Home For Y2K" and "Preparing Your Apartment For Y2K", address situations specific to homes. This information is also available on CMHC's web site at: www.cmhc- schl.gc.ca CMHC is working with other government departments departments to co-ordinate and share information dealing with year 2000 housing preparedness. preparedness. While it is not known exactly what the extent of problems on January 1, 2000 will be, there arc some reasonable preparations we can make in our homes. These two new CMHC fact sheets will help smooth the transition to the next millennium. While most authorities agree few household appliances appliances will be directly affected, affected, the bigger. problem for home owners appears to be whether utilities will be able to supply electricity, natural gas, water and telephone service without interruption. Utility companies have indicated indicated the Y2K problem should not affect services. To be safe, consult local utilities to see if they have any recommendations recommendations for Y2K preparation. Homeowners should check newer furnaces and electronic thermostats, heat pumps, security systems, garage door openers, in- house elevators and medical devices (oxygen, dialysis, personal alert). Contact manufacturers manufacturers or dealers to see if appliances are compliant. Apartment dwellers, especially those in high-rise units, have additional concerns, concerns, They should enquire about the central building systems, such as front door opencrs/vestibule intercoms, security systems and elevators, elevators, which arc all the responsibility of the building management. Contingency plans, to deal with potential disruptions, should be in place as well. FOCA wants a commitment that .increased funding will be provided to the Ministry of the Environment and the Ministry of Natural Resources, including Ontario Parks, so that they can adequately adequately carry out their mandates. FOCA wants a commitment that land use in newly established provincial parks and conservation reserves will be determined on a case-by.-casc basis. Local citizens citizens should play a major role in deciding on permitted permitted uses such as hunting, commercial commercial fishing, fur harvesting, wild rice harvesting, harvesting, tourism facilities, facilities, recreation trails and others. This is common sense as well as being a basic democratic right. We do not want government to legislate what can and cannot take place in our parks and conservation reserves. The incoming govern m c nt should reintroduce reintroduce the Cottage Pollution Control Program previously previously administered administered by the Ministry of the Environment, or an equivalent program with a (I e tj u tt t e resources. Ask for the minutes for the past 12 months of the condominium association. Look for items such as high crime rates, imminent repairs and noise complaints. 3. Check with the city to make sure another building isn't slated for construction in front of the one you are interested in. 4. If applicable to your province, ask your realtor for the property condition disclosure statement. It requires the owner of the property to disclose things such as imminent repairs to the roof. 5. Ask about condominium fees, past, current and projected. Do the fees include utilities? 6. Check out the common facilities in the building and decide how much use you will get out of them. You will end up paying for the upkeep of a pool or workout room whether you use it or not. 7. Read over the complex's bylaws. Find out how many units are rented, how many are owned and whether items such as pets, barbecues or exterior decorations are allowed. 8.
