The three-judge panel also rejected j an appeal of Junior Christopher Brown's conviction, agreeing with the trial judge that a delay of more than 16 months in bringing the case to trial was not unreasonable. The appeal court decision means Mr. Brown will continue to serve the sentence handed him in the fall of 2004 by Superior Court Justice Clair Marchand, who heard the case in Whitby. Justice Marchand sentenced Mr. , Brown to nine years on top of the time he'd spent in pretrial custody for a total term of 11 years in federal penitentiary. Mr. Brown was 19 when he went on a robbery spree with two other teenagers in the spring of 2003. Masked and armed with knives and in one instance a handgun, the crew swarmed helpless convenience store clerks as they worked alone at night, beating and stabbing the victims before fleeing with cash, cigarettes and lottery tickets.
