Page A2 ♦ THE CANADIAN STATESMAN ♦ July 19,2006 s MAYOR JOHN MUTTON Leading the Way 905-623-3379 MAYOR'S CORNER BILL 43 In response to the Walkerton Inquiry, Justice O'Connor made a number of recommendations to protect and ensure the safety of drinking water in Ontario. The Provincial Government is currently considering Bill 43, the Ontario Clean Water Act which they hope to have third reading for before the summer recess of the House. The primary goal of the bill, the Clean Water Act will require municipalities to work together in watershed groupings to identify what are the potential and significant risks to groundwater and surface water supplies, to our drinking water. Considerable effort will go into that risk identification, the mapping of watersheds and potential threats to our drinking water within those watersheds. The Municipality of Clarington supports the concept of locally developed source water protection plans. However, we along with the agricultural community are very worried about the implementation, the questions of "what will be done, how and by whom" are not addressed by the Act and to date the associated regulations have not been released for review. Bill 43, raises many issues for municipalities, rural landowners, farmers and rural business'owners/operators, conservation authorities and rural residents. While the Province has tried to reassure stakeholders that the focus will.be municipal wellhead protection; the wording of the Act is much broader and depending on the implementation may affect surface water intake zones. This means that any lands that contribute water within the intake protection zone of a river or tributary from a municipal intake would be affected. Lands within the zone would have a buffer on either side of the river or stream and activities may be restricted. There are just too many unanswered questions for municipalities, who are going to be handed the implementation and enforcement of this legislation, (more downloading); and the agricultural community, whose lands, business operations and profitability will be affected to be happy about this legislation. To date, the concerns and comments of the agricultural producers have not been incorporated into Bill 43. Bill 43 has received second reading and been referred to Committee for public hearings. The hearings are to take place across Ontario during the third week of August with all comments due by the end of August. For this area the closest hearing location will either be Peterborough or Toronto. To attend and speak to the proposed legislation you will have to register in advance With the committee secretary. Clarington Council recently endorsed the resolution of the Agricultural Advisory Committee of Clarington calling for the provincial government to: a) provide adequate funding under the Clean Water Act to land owners; b) review the implementation strategy with, and to the satisfaction of the commodity groùps [such as Ontario Cattlemen's Association, Ontario Pork and Ontario Sheep Marketing Agency] and the Association of Municipalities of Ontario before it is included in the regulations; c) transfer adequate funds to the municipalities for the implementation.
