The judge declared a mistrial and released a jury that had heard sev eral days of evidence, telling them, "It appears witnesses from whom you have heard lied to this court and lied to you. "It's a bizarre development and a very unusual one," Justice Clark said. The judge had the men once again arraigned on the charges, then acquitted them outright. Outside court a relieved Mr. Kondell fought back tears as he recounted the loll the accusations and subsequent trial have taken. "I've lost everything," he said. "I've lost my business." Mr. Kondell worked his way up through the management hierarchy at the Wendy's chain, becoming the first black franchise owner in Canada, said his lawyer, David Gillespie. "He lost his ownership in Wendy's because of these false allegations," Mr. Gillespie said. Mr. Gillespie noted the remarkable instruction issued by Justice Clark when revelations of false testimony were" made. "What's happened today is Justice Clark directed the Crown to direct the police to undertake an investigation of the Crown's own witnesses,! think that's a serious matter," he said. A ban on publication of complainants' names in the case remains in place.
