This is for more than one rea- son a very disappointing decision. “,5 The learned judge at the outset laid tc down the dictum that “ the courts do 3 not interfere with the preponderating cl will of the electors except for the n 'clearest and plainest reasons.†It N cannOt be said that such a majority e' did not express the preponderating C will of the electors, but unfortunate- ly there is room for wide diï¬erence of Opinion as to whether the reasons are " clear†and “ plain†enough to justify the nulliï¬cation of the popu- lar eclaration at the polls. By a process of exclusion that is by no means easily followed the majority of 467 is cut down to 60. Under the law as it then stood this majority was ~till ample for the purpose, but even that was over ridden on account ol "very many glaring omissions and 1 irregularities†which “appearin con. ; nection with proceedings upon the ' vote.†Those irregularities that are speciï¬ed in the judgment are highly technical: that 18 to say, they are of such a nature that there is no reason to suppose they materially affected the issue.
